Position

As a Partner at Tuca Zbârcea & Asociatii, Robert Rosu co-heads the firm`s litigation and domestic arbitration practice group, the largest department within the firm. He is also responsible for the implementation of a business-oriented approach aimed at assessing the best course of action to be taken in dealing with litigation matters to the advantage of our clients.
His practice covers a broad range of litigation matters in the following areas: commercial litigation, usually involving company law and shareholder disputes, administrative, competition, employment, intellectual property, taxation as well as enforcement procedures and criminal litigation.
In addition, he is a resourceful litigator who has briefed and argued a number of complex and high-profile cases at the International Court of Arbitration, having acted on behalf of the Romanian government and various foreign investors. Further to his practice in litigation and arbitration, he has been involved in several important state-owned enterprise privatizations as well as acquisition transactions in the private and public sectors.

The nine-partner practice at Ţuca Zbârcea & Asociaţii is well regarded for both domestic and international arbitration. It represents Gabriel Resources (Canada) and Gabriel Resources (Jersey) in proceedings initiated against the Romanian state regarding a proposed breach by the Romanian government of the Agreement for the Promotion and Reciprocal Protection of Investments made with Canada, Great Britain and Northern Ireland. The team also represents Alstom Transport in a dispute with CFR in relation to public acquisition contracts totalling €290m. Robert Roşu, Cornel Popa, Ioana Hrisafi-Josan and Levana Zigmund are the names to note.

Ţuca Zbârcea & Asociaţii is notably representing the Romanian Football Federation, a civilly liable party, in a criminal dispute concerning allegations of official misconduct. Ioana Hrisafi-Josan and Robert Roşu head the practice, which is reputed for its work on corruption matters, occupational and IP crime, money laundering, tax evasion and financial fraud.

  • The Dispute Resolution Review Sixth Edition - Romania

    Disputes in Romania are settled in court in the vast majority of cases, under procedures regulated mainly by the new Civil Procedure Code (CPC). The CPC entered into force on 15 February 2013, has carried out a systemic and extensive overhaul of the Romanian dispute resolution model. With a specific focus on acceleration of trial proceedings, the new regulation has reformed both the schedule and the content of proceedings taking place in various phases of the lawsuit, while attempting to clarify many of the controversies raised by interpretable provisions in the former regulation.
