Position

As a partner at Ţuca Zbârcea & Asociaţii, Robert Rosu co-heads the firm`s litigation and domestic arbitration practice group, the largest department within the firm. He is also responsible for the implementation of a business-oriented approach aimed at assessing the best course of action to be taken in dealing with litigation matters to the advantage of our clients. Robert Rosu`'s practice covers a broad range of litigation matters in the following areas: commercial litigation, usually involving company law and shareholder disputes, administrative, competition, employment, intellectual property, taxation as well as enforcement procedures and criminal litigation. In addition, he is a resourceful litigator who has briefed and argued a number of complex and high-profile cases at the International Court of Arbitration, having acted on behalf of the Romanian government and various foreign investors. Further to his practice in litigation and arbitration, he has been involved in several important state-owned enterprise privatizations as well as acquisition transactions in the private and public sectors. Robert Rosu is also an insolvency practitioner and coordinator of TZA Insolventa S.P.R.L., a specialized unit which manages liquidation and insolvency projects.

Career

Robert Rosu is one of the founding partners of Ţuca Zbârcea & Asociaţii. For the past 11 years, Robert coordinated the legal teams appointed by various companies and institutions for important projects and transactions, OMV Petrom, Erste Bank / BCR, ArcelorMittal, CEZ, Zentiva, Carrefour, Siemens Romania, Banca Transilvania, Orkla Foods, Hidroelectrica, Romanian National Television, Alstom Transport, UPC Romania (the biggest Romanian cable television provider), Authority for Privatization (AVAS), SIF Muntenia and many others. The recent outstanding projects in which he took part are: assisting Siemens Romania group of companies in various litigation cases with an aggregate value of EUR 66,000,000; assisting Glencore Energy UK Ltd. in complex commercial litigations aiming at the recovery of a receivable of approximately EUR 80,000,000, resulting from a framework-agreement concerning petroleum supply; assisting Tenaris during the assets recovery procedures, with a value of over 32,000,000 USD, belonging to the company Siderca SA; assisting Erste Bank / BCR in legal proceedings for the recovery of a debt totaling approximately USD 30,000,000 resulting from various bank loan agreements concluded by BCR with Energo Mineral SA and guaranteed inter alia by Cuprom SA; coordinator of the legal team retained by CEZ company in relation to EUR 50,000,000 complex commercial disputes; coordinator of the legal team retained by Fortus Iasi in a EUR 40,000,000 fiscal litigation arising from the annulment of the fiscal incentives previously granted to Fortus Iaşi following the privatization process; coordinator of the legal team assisting Corporate Recovery Management, a debt recovery agency, member of MKB Romexterra Group in approximately 20 cases before the courts of law on insolvency proceedings for the recovery of debts with a total value of approximately EUR 23,000,000; coordinator of the legal team retained by Zentiva in several complex real estate litigation files, with an estimated value of over EUR 20,000,000. Robert Rosu has published a range of articles on insolvency, litigation and corporate law.
