The law firm FKA Furtek Komosa Aleksandrowicz advised ECI-Skarbiec Real Estate Non-Public Asset Closed-End Investment Fund on two issues of this funds secured bonds, with a total value of PLN 45 million, placed in private transaction earlier this year. The Issuer is a closed-end investment fund, whose business includes investing in commercial real estate in Warsaw.

We are pleased to announce that, on 23 February 2012, the Presidium of the Polish Chamber of Commerce appointed attorney Marek Furtek to serve as President of the Court of Arbitration at the Polish Chamber of Commerce (PCC) in Warsaw, for another three-year term. Attorney Marek Furtek has served as the President of the Court of Arbitration at the PCC since March 2009.

FKA Furtek Komosa Aleksandrowicz took part in a panel of legal advisors advising Astra Zeneca in relation to the global sale of its Astra Tech dental and medical devices business to the US dental giant Dentsply International. Astra Tech is a global leader in dental and healthcare (urological and surgical) products, services and support. FKA advised on the sale of the Polish part of Astra Tech. The transaction, valued at $1.8 billion, was completed on 31 August 2011.

The law firm FKA Furtek Komosa Aleksandrowicz has advised Bank Ochrony Środowiska (BOS Bank) on a private placement of 3-year notes issued by BOS Bank in series E and F, with an aggregate face value of PLN 380 million (appr. EUR 86 million), organised with the participation of BRE Bank, Bank Gospodarstwa Krajowego and Dom Maklerski BOŚ (the brokerage house).

The law firm FKA Furtek Komosa Aleksandrowicz advised Bank Ochrony Środowiska on the issue of 10-year, series D bonds under a private placement, with a value of PLN 100 million (EUR 25 million), organised with the participation of Bank Gospodarstwa Krajowego.  The series D bonds are dematerialised, with records kept by the National Depository for Securities (KDPW) and, after the consent of the Financial Supervision Authority (KNF) has been obtained, they will constitute a subordinated loan of the bank.

FKA Furtek Komosa Aleksandrowicz has advised Philips Lighting Poland on the sale and lease back of warehouse and office buildings in Pila.

FKA Furtek Komosa Aleksandrowicz advised BOŚ Bank, one of the leading Polish banks, in a PLN-denominated bond programme (multiple non-public issues up to a face value of PLN 1 billion, the equivalent of EUR 250 million) organised by BRE Bank (a Polish affiliate of Commerzbank group), BGK (a state-owned bank) and DM BOŚ (a leading brokerage house) and in the first two tranches of three-year bonds with an aggregate value of PLN 700 million (series B and C issued in November 2010).

FKA Furtek Komosa Aleksandrowicz advised Polkomtel, a leading Polish mobile operator, on a new 5-year program for several private issuings of PLN-nominated short and mid-term bonds (commercial papers) with a maximum indebtedness limit under the program of PLN 1 bln (appr. EUR 240 M).

On 26 March 2009, the Presidium of the Polish Chamber of Commerce elected Marek Furtek as President of the Court of Arbitration at the PCC. He will succeed the previous President, Mr Piotr Nowaczyk.
