AstapovLawyers successfully represented a leading Japanese chemical engineering firm Showa Denko
It was the first case reviewed by a supra-national commission after the establishment of the Customs Union. According to the Commission’s Notice as of August 30, 2012, the special safeguard investigation was closed.
AstapovLawyers International Law Group advised a leading Japanese chemical engineering firm Showa Denko in the special safeguard investigation regarding the increased import of the graphite electrodes to the united customs territory of the Customs Union of the Russian Federation, Belarus and Kazakhstan.
The investigation was initially held by the Ministry of Industry and Trade of the Russian Federation and then transferred to the Eurasian Economic Commission. It was the first case reviewed by a supra-national commission after the establishment of the Customs Union.
According to the Commission's Notice as of August 30, 2012, the special safeguard investigation was closed. As a result of well-reasoned position of our client and other defendants during the proceedings, it was decided not to apply any safeguard measures by reason of absence of sufficient grounds. In particular, the Commission indicated that there is a lack of causation between growth of import and injury to domestic producers. The investigation took one year.
