Andrey Samoilov spoke at the ABA’s 5th Annual Moscow Dispute Resolution Forum

Andrey Samoilov, Senior Associate of AstapovLawyers ILG, spoke at the ABA's 5th Annual Conference on the resolution of the CIS-related Business Disputes, which took place on 27 September in Radisson Royal Hotel Moscow, Russia. His topic covered "Private enforcement in antitrust matters - private follow-on actions in CIS".

Andrey's presentation focused on the current situation in the CIS. He stated that around 10% of all matters handled by the antitrust authorities are challenged in the court. Most of those are matters on abuse of dominance, to a lesser extent the cases on concerted actions (cartel agreements). Currently private enforcement of competition law matters is not very popular instrument in the CIS in comparison with the EU, where the situation was similar (there were 60 claims in over 40 years) until a profound reform has been initiated on facilitating private enforcement in competition law matters on national level of member states as well as the EU level.

Thus, Andrey raised this question and introduced or reviewed some of the core instruments that should be used to enhance the private enforcement actions in the CIS.

The event, organized by the American Bar Association and International Chamber of Commerce of the Russian Federation, hosted major Russian and CIS-based law firms. The topics of the conference covered:
