AstapovLawyers successfully represented the interests of Conres Shipping AG

17.02.11 - AstapovLawyers successfully represented the interests of the Conres Shipping AG (Conres), a prominent German grain trader, in a dispute with the Alphamate Commodity GmbH. The dispute originated from Alphamate’s failure to pay the agreed price within the time-limits established by the Contract between the parties for the sale of the barley. Conres declared the contract terminated and re-sold the barley to another buyer while the goods remained on-board the vessel.

However, believing it interests infringed, Alphamate launched proceedings against Conres and the ship-owner, alleging piracy, unlawful appropriation of goods and breach of the Contract. This resulted in several intertwined proceedings in Lebanon (where the barley was unloaded), Germany and England.

AstapovLawyers represented Conres before the GAFTA Arbitration and coordinated the activities of Lebanese and German lawyers in civil and criminal proceedings before the courts and prosecution offices of their respective countries. As the result, the goods arrested in Lebanon were released and collected by the end buyer. Moreover, despite the opposite party's defamatory accusations against Conres and the ship-owner and the proceedings brought against them in Lebanese court, the attack launched against the vessel was also successfully repelled.

The opposing party was unprepared to play several chess-boards simultaneously, i.e. to handle several sets of proceedings of different legal nature (criminal, civil, arbitral) in three different jurisdictions, whereas our firm specialises in provision of exactly these services.
