The firm proved wrongfulness of the cast iron storage rate increase

August 2010

Our client, a major Russian steel producer, sought refund of the storage fees paid to the port in connection with the cast iron storage. As it turned out, the port raised storage rates without any valid reason in early 2010.

"The key points of our strategy were to prove that the port was not entitled to increase the rates without prior consultation with the client, and then to recover fees wrongfully collected by the port. The court satisfied our claims in full and rendered that the mentioned rate increase was unlawful," says Oleh Gromovoi, associate of AstapovLawyers who represented our client in this matter.

"This victory is the logical outcome of the well-coordinated work and consistent efforts of our team. Our main tasks in these proceedings were to choose the best trial strategy and foresee any potential steps of our opponents. As a result, such careful and thoughtful approach enabled us to successfully manage the dispute and win the case," said Oleh Beketov, Counsel and Head of the AstapovLawyers' International Litigation Practice.

  • How much does it cost to use ‚Äúproprietary‚ÄĚ TM?

For many international companies, it is a common practice to allow the use of their trademarks (TM) to all group companies on a free of charge basis. Some parent companies do not even have a right to charge the royalty payments from their subsidiaries, as this contradicts the company’s policy. In the case of subsidiaries located in the territory of Ukraine, such a situation suits everyone, at first glance, because royalties do not have to be paid at all.
