New Political Culture for the Judicial Reform

June 2016

On 18th of May 2016 in the newspaper “Sega” was published the very up to date article of Mr. Vladimir Penkov, Managing Partner of Penkov, Markov & Partners – International Law Firm, dedicated to the judicial reform and particularly to its content and the prerequisites and requirements for its completion.

Att. Penkov highlighted the importance that after more than 20 years of talking, the judicial reform was finally initiated. Mr. Penkov also raised the question of the necessity for a change in the political culture of all of us, in order to guarantee success. This is the only way to prevent any political, economic or administrative influence on the court.

In the article also is pointed out the necessity for a complete separation of the competences of the two chambers, where all issues concerning the appointment and the growth of the judges should be a prerogative only to the chamber of judges, including the appointment of the Chairmen of the Supreme Courts.

It should also not be allowed when appointing the judges, the latter not to have obtained the necessary qualification and experience and to be appointed directly in the higher courts.

An important proposal is also the decentralization of the prosecution offices to the extent to which they are included in the judiciary, where each prosecutor should be independent in performing his activities, and the General prosecutor should be a subject of an independent monitoring and should be obliged to give reports.
