Penkov, Markov & Partners partakes in a seminar in Protection of Intellectual Property: Practical Issues, organised by the National Union of In-house Lawyers, Sofia

A lawyer of Penkov, Markov & Partners represented the law company in an intellectual property seminar held from 30 November to 2 December 2011 in the House of Legists, 7 Pirotska Street, Sofia. The presentationā€”titled Parallel Imports in the Light of Copyright and Trade Mark Rightā€”given by Yordan Politov, an associated member of the law company and  an intellectual property representative, was aimed to shed light on unsettled issues of Bulgarian case-law regarding trade mark infringements in the course of parallel imports.

This topic is also relevant in the context of the pending revision of Interpretative Ruling No. 1 of the Supreme Court of Cassation of 15 June 2009 in Interpretative case No. 1/2008 of the General Meeting of the Commercial College. The revision of the ruling is much needed, in the opinion of several non-governmental organisations operating in the field of intellectual property, including the Bulgarian National Group of AIPPI and the Intellectual Property Development Associationā€“Bulgaria. Because of the apparent contradiction of the interpretative ruling with the Court of Justiceā€™s settled case-law on that matter, earlier this year, these NGOs referred the issue to the President of the Supreme Court of Cassation, Prof. Lazar Gruev.
