The firm: With three London offices, the firm provides the quality of service expected of a City firm to both individuals and businesses nationally. It is rated as a leader in the field for claimant clinical negligence and personal injury and has also consistently maintained a national reputation for family, housing and administrative and public law.

Types of work undertaken: Company and commercial: the team’s understanding of commercial objectives and trading methods is an integral part of its service to all types of business. It deals in the acquisition and disposal of companies and unincorporated businesses and general commercial contracts. It has a growing specialism in complex intellectual property issues.

Commercial dispute resolution: the team deals with contractual disputes involving national and international content and has a particular expertise in computer, engineering and intellectual property and a thriving professional negligence practice acting for both businesses and individuals.

Employment: the employment team has a strong contentious and non-contentious practice in this fast changing area of law. It advises on best employment practices, as well as dealing with disputes. The team represents employees in a wide range of contentious employment matters including unfair dismissal and discrimination. It has considerable experience in advising high-net-worth employees and negotiating service and compromise agreements.

Family: this well-recognised team, led by Kim Beatson, offers expertise in all areas of family law with a particular emphasis on complex, high-net-worth financial disputes. The team has wide experience in international financial matters including freezing injunctions in multiple jurisdictions. The team also pioneers alternatives to litigation and operates one of the most highly regarded mediation and collaborative law services in London. The firm is known for its expertise in advising gay and lesbian clients on matters concerning cohabitation agreements, civil partnerships and relationship breakdown.

Personal injury: the firm acts for claimants and is recognised as one of the leaders in the UK with particular expertise in catastrophic brain and spinal cord injury where David Marshall and Jenny Kennedy are the top ranked practitioners. The team also handles child abuse claims and a wide range of general personal injury claims. All solicitors are members of APIL, David Marshall is a past president and Jon Nicholson is the London Co-ordinator. A specialist Court of Protection team headed by David Wedgwood, ensures those lacking mental capacity as a result of an accident, have their financial positions thoroughly maximised and protected.

Clinical negligence: headed by Jon Nicholson, the team includes five members who are accredited by the Solicitors Regulation Authority. Jon Nicholson and Stephanie Prior are also members of AvMA’s Specialist Clinical Negligence panel. The team has over 20 years’ experience dealing with the whole range of clinical negligence work for claimants, with particular emphasis on brain injury, birth injury, orthopaedic and psychiatric cases.

Housing, public law and human rights: the team, led by Andrew Brookes, a leading practitioner, is renowned for challenging public decisions from local authority housing departments, planning departments, social services and education authorities. Acting for both landlords and tenants the team specialises in all aspects of housing, community care and human rights. The team also deals with social welfare provisions and disputes over housing benefit and community care.

Property dispute resolution: the team acts for both residential and commercial landlords and tenants to find solutions in disputes that include dilapidations, lease renewals, service charges and management disputes.

Property: the firm has a strong practice in all property transactional work including commercial leases, property development, financial and investment work and conveyancing. A specialism in lease extension and leasehold enfranchisement work further strengthens the firm’s property services.

Wills, trusts tax and probate: as well as advising on tax planning for businesses and individuals, the team deals with the administration of estates and trusts. The firm also has a considerable reputation and expertise in disputes involving the validity of wills and breaches of trust.

Court of Protection: the team is regularly instructed where there are inter-family disputes involving finances of persons lacking capacity.

  • COUNCIL TAX

    In Harrow LBC v Ayiku [2012] EWHC 1200 (Admin) Sales J held that the word “or” in the Council Tax (Exempt Dwellings) Order 1992, art 3 Class N, had a disjunctive meaning, therefore it was sufficient for the non-British spouse of a foreign student to satisfy one or other of the two conditions, namely being prevented from taking paid employment or being prevented from claiming benefits, in order to qualify as a “relevant person” who was exempted from liability to pay council tax.

    In R (Calver) v Adjudication Panel for Wales [2012] EWHC 1172 (Admin) Mr Calver was a member of Manorbier Community Council who successfully challenged the decision of the Panel to dismiss his appeal against a decision by Prembrokeshire County Council Standards Committee censuring him for a number of comments or blogs posted by him on a website he owned and controlled.

  • Judicial Review

    The Judgment of Lindblom J in The Manydown Co Ltd v Basingstoke and Deane BC [2012] EWHC 977 (Admin) repays attention. The Claimant sought to challenge by judicial review 2 decisions of the Council: (1) the Council’s refusal to reconsider its position on the development of a site that it owns (and is the subject matter of a Joint Development Partnership Agreement with the Claimant); and (2) a decision of the Council’s Cabinet approving a selection of sites for development which did not include this site.
