  • Harmonising Anti-Circumvention Protection with Copyright Law

    Technological measures are increasingly used by rightholders in order to protect their intellectual property rights in digital content. The effect of such measures is to restrict the access to and the use of digital content, by associating pre-defined and self-executing usage rules with it. Within an increasing number of legislations, technological measures enjoy legal protection against circumvention. However, these new rules have been subject to rather severe criticism, especially from a copyright law point of view, the general claim being that anti-circumvention protection threatens to ruin the delicate balance of interests cast in the provisions of copyright law.

    ISDA (International Swaps and Derivatives Association) er en sammenslutning av mange internasjonale finansinstitusjoner. Et av formålene til ISDA er å legge til rette for en standardisering av unoterte derivattransaksjoner, vanligvis referert til som OTC (Over-The-Counter) derivater.   • Legemidler til barn

    Forordning (EF) nr. 1901/2006 om legemidler til barn ble vedtatt i EU i desember 2006 og trådte i kraft i EU 26. januar 2007. Høringsfristen for forslaget fra Helse- og omsorgsdepartementet om gjennomføring i norsk rett gikk ut 9. oktober 2009. Forslaget omfatter endring av legemiddelforskriften og patentloven. Departementet har til hensikt å fremme lovproposisjon med de nødvendige endringer så snart som mulig, men avventer vedtak i EØS-komiteen, med de nødvendige tilpasningstekster (overgangsregler), som tar forordningen inn i EØS-avtalen.

  • Ny saldogruppe - Fast teknisk installasjon i bygninger (skatteloven § 14 -41 (1) j.)

    Med virkning fra inntektsåret 2009 skal faste tekniske installasjoner i avskrivbare bygg skilles ut i en egen saldogruppe "Fast teknisk installasjon i bygninger". Driftsmidler i denne gruppen avskrives med inntil 10 % av saldoverdien årlig. Det skal være en samlesaldo for hvert bygg som inkluderer alle faste tekniske installasjoner i bygget.

    NORWAY TO IMPOSE LICENSING REQUIREMENTS IN RELATION TO PARTNERSHIPS Norwegian authorities intend to close a regulatory loophole according to a recently published proposal for amendments to the Norwegian Securities Trading Act. Under the proposed amendment, providers of intermediary services, such as distributors of private equity funds and other closed ended collective investment schemes, must be licensed as investment firms when offering shares in partnership structures to non-professional investors in the Norwegian market.

  • Migration of Norwegian companies to Europe

    EF-domstolen har nylig avsagt en avgjørelse (Cartesio - C-210/06, 16. desember 2008) hvor det konkluderes med at den enkelte EF-medlemsstat kan forhindre at selskaper som er stiftet etter denne statens rett, flytter til en annen EF-medlemsstat. Dommen er basert på EF-traktaten art. 43 og art. 48 som tilsvarer EØS-avtalen art. 31 og art. 34. Dommen skal derfor etterleves også i Norge. Dette innebærer at dagens rettsoppfatning, om at norske selskaper ikke kan flytte til andre EF- og EFTA-medlemsstater uten å oppløses og avvikles, ikke er i strid med europeisk rett.
