Kluge advises Wintershall in major swap transaction on the Norwegian Continental Shelf (NCS)

Wintershall and Statoil announced Monday the 22.th of October a transaction whereby Wintershall will acquire interests in the Brage (32,7%), Gjøa (15%) and Vega (30%) fields. As compensation Wintershall will transfer a 15 % interest in the Edvard Grieg field to Statoil in addition to paying a cash consideration of USD 1,35 billion. An additional payment of up to USD 100 million will be paid contingent on the successful future development of the Vega field. Further, it is the joint intention of the parties that Wintershall takes over the operatorship of Brage. This is one of the largest licence transaction on the NCS.

Kluge has won two call-offs from DIFI

In February 2009 Kluge was awarded a framework agreement as one of three suppliers of legal services to  the Agency for Public Management and eGovernment (DIFI). Kluge has won two of the calls for services under the agreement. Kluge’s head of IT law, partner Torstein Arendt, has assisted DIFI with a revision of the governmental standard agreements (SSA) for IT procurement and consultancy services. The revised  standards have been well received in the Norwegian IT media and among the user group. The general opinion is that they will be used frequently and set the standard for IT agreements in future IT projects.

  • Norway not included when short sale regulations in EU take effect 1 November 2012

    From 1 November 2012 EU Regulation 236/2012 on short selling and certain aspects of credit default swaps will come into effect. Although the Regulation is within the scope of the EEA Agreement, Norway has not implemented the EU Regulation. Based on unofficial information from the Norwegian authorities, we expect the implementation process to be delayed until at least late 2013. Meanwhile, existing rules on short sale in Norway will continue to apply for transactions performed on the Norwegian market.
