Position

Rachel is a director in the mental health and mental capacity departments at Duncan Lewis. Rachel specialises in all aspects of mental health law, and has particular expertise in representing patients detained in adolescent mental health units and in restricted mental health cases. 

Rachel undertakes her own advocacy at First-tier Tribunal hearings, representing clients in order to restore their liberty. She travels across the country to advocate on behalf of clients, endeavouring to undertake representation from beginning to end of the case; this will include undertaking Tribunals, Managers Hearings and attendance at Section 117 aftercare meetings.

In many cases her clients are considered to lack capacity and consequently, she is appointed to act in their best interests. She has extensive experience of representing clients subject to civil sections, such as section 3 and section 2 and also forensic sections of the Mental Health Act 1983 (as amended by the 2007 Act).

Rachel also has broad experience in all Court of Protection matters. In instances where individuals are worried about losing the ability to manage their finances or who will make decisions about their welfare in later life, Rachel has significant expertise in cases involving Lasting Powers of Attorney.

Career

Rachel qualified as a solicitor in 2008 and joined Duncan Lewis as a partner-level director in 2015.

Rachel is fluent in French.

Rachel is a Legal Aid Agency Supervisor and accredited Law Society Mental Health Panel member which ensures her clients and their representatives can easily recognize and trust her abilities as a legal practitioner with proven competency in mental health law. She is also a member of the Mental Health Lawyers Association (MHLA) which means she has excellent capabilities in this area of law.

Education

Rachel completed a BA (Hon) degree in Law with French at Newcastle Upon Tyne University before completing her LPC at the College of Law, London.
