WKB publishes in the monthly “Public Sector Investments” [“Inwestycje Sektora Publicznego”]

August 2012

As of May 2012, our firm has published four articles dedicated to public private partnership issues in the monthly “Public Sector Investments” (PSI). All four publications were authored by: Anna Flaga-Martynek, legal counsel and Jerzy Masztalerz, lawyer. The following articles have been published to date:

  • “Boundaries of developing PPP in Poland” (PSI, August 2012),
  • “PPP implementation – partner selection” (PSI, July 2012),
  • “Most common co-operation structures within the PPP” (PSI, June 2012),
  • “Public-private partnership – opportunity or threat” (PSI, May 2012).

WKB lawyers work on further publications on PPP. The next article will be dedicated to the recent proposals put forward by the European Commission regarding the directive on the award of construction works and services concessions.

PSI in a brief:

"Public Investment Sector" is the only magazine on the market which addresses the needs of people responsible for public administration investments in a broad sense. It supports investor and constructor decisions at all stages of undertaking: from drawing up the design and obtaining the necessary permits through to implementing and accepting the investment. The published articles provide a thorough insight into the issues connected with i.a. construction law, investment valuation and settlement and obtaining funding from EU funds. The monthly also presents the state-of-the-art technologies that can be used when implementing public investments.

The authors:

Anna Flaga-Martynek

A graduate of the Faculty of Law and Administration at the University of Warsaw and of the Faculty’s American Law School, Anna is a legal counsel and a member of our infrastructure and litigation teams. She is also a member of the International Bar Association and the Social Communications and Information Committee at the Circuit Chamber of Legal Counsel in Warsaw. Anna provided legal advice at all stages of one of Poland’s largest infrastructure projects, which the Polish government considered to be of strategic importance to national energy security (LNG Terminal in Świnoujście). Expert in projects concerning linear, building and industrial investments, as well as other infrastructure projects, including renewable energy. She regularly advises our clients at all stages of their infrastructure projects, including those based on FIDIC standard contracts implemented as concessions for construction works and public private partnership, and provides advice on resolution of infrastructure disputes.

Jerzy Masztalerz

A graduate of the Faculty of Law and Administration at Adam Mickiewicz University in Poznan, Jerzy is a lawyer in both our public procurement team and infrastructure teams. He advises both contractors and contracting authorities and bodies on all procurement matters. Jerzy specialises in public procurement law, company law and PPP issues. He advises entities from the transport and energy sector and provides assistance to WKB’s clients involved in infrastructure projects implemented on the basis of FIDIC contract conditions. Jerzy represents his EU-funded clients before managing authorities, intermediaries and implementing bodies and develops legislative postulates connected with amendments to the  public procurement law.
