Position

Kit has broad commercial dispute resolution experience, often with a significant international/cross-border element. He specialises in disputes and investigations involving aspects of banking and finance, fraud, insolvency, and asset tracing. His experience includes advising in respect of injunctions (including anti-suit injunctions), major disclosure exercises, and supervision of litigation in numerous international jurisdictions. Kit’s recent experience includes advising the co-promoter of Jersey-based collective investment funds with substantial property investments in Bulgaria, Croatia and Montenegro in respect of applications by the Jersey Financial Services Commission to wind up the funds, advising a Kozaczek finance entity in a €120m claim involving currency and credit default swaps against a major bank; advising Chinese owned companies in the BVI and Hong Kong concerning guarantees given to support freight futures trading in iron and steel, and in respect of insolvency issues; and advising the liquidators of E-Clear, the failed online payments company in respect of potential claims.

Kit has written numerous articles, including articles in the ‘Journal of International Banking and Finance’ on hedge fund fraud and the potential liabilities of prime brokers, on hedge fund side letters, and on cross-border privilege issues. Kit is also a regular speaker at seminars.

  • Is comparative advertising unfair?

    THE EUROPEAN COURT OF JUSTICE (ECJ) IS IN THE midst of considering questions referred to it by the UK courts in three separate cases that should clarify the law regarding comparative advertising. This type of advertising, particularly when it identifies a competitor or a competitor’s goods or services by referring to a registered trade mark, is of particular concern to trade mark owners as their competitors normally seek to make unfavourable comparisons with their own goods or services, or to take advantage of being associated with the market leader’s brand.
