Career

Stijn has litigated in cases in all fields of intellectual property law with a particular focus on patents and trade marks as well as in several related fields such as unfair competition law and sports law. His clients include multinationals in the retail (particularly fashion and toys), pharmaceuticals and chemicals sectors.

As far as non-contentious work is concerned, he advises frequently on pharmaceutical law (also on non-IP related issues such as clinical trials, advertising and pricing and reimbursement issues) and assists pharma companies and other research-driven undertakings in drafting and negotiating research and development, Joint Development and other IP-sensitive agreements.

In a recent highlight, Fieldfisher's IP team was appointed as exclusive counsel to the European Commission on contentious and non-contentious intellectual property matters, and has been advising the Commission on patent infringement issues. The firm is also representing Levi Strauss in trade mark infringement proceedings against Kenzo. The 'super efficient' Stijn Debaene and 'very responsive' Hakim Haouideg  are the key individuals.

  • Is comparative advertising unfair?

    THE EUROPEAN COURT OF JUSTICE (ECJ) IS IN THE midst of considering questions referred to it by the UK courts in three separate cases that should clarify the law regarding comparative advertising. This type of advertising, particularly when it identifies a competitor or a competitor’s goods or services by referring to a registered trade mark, is of particular concern to trade mark owners as their competitors normally seek to make unfavourable comparisons with their own goods or services, or to take advantage of being associated with the market leader’s brand.
