Position

Partner and head of IP and technology dispute resolution group (seven partners, 11 assistants). Nick’s work covers a broad range of intellectual property, including trade marks, copyright, designs, confidential information and domain names. Also recommended in ‘International Who’s Who of Trade Mark Lawyers’ 2010 and ‘Euromoney’s Leading Trade Marking Practitioners’ 2008.

Career

Qualified 1983; joined Field Fisher Waterhouse 1985; partner 1988. Nick has acted in a number of leading reported IP cases in recent years, including: HISL v MHSL & Others (unregistered design rights in firemen’s helmets; (2007) IRLR 126); Navitaire v easyJet (copyright infringement in computer software and datasets; (2006) RPC 3); Ordnance Survey v Automobile Association (copyright infringement in large-scale and small-scale mapping; [2001] ECC 34); Music Gallery v Direct Line and Others (copyright in music; (1998) EMLR 551); Zockoll Group v 800 Flowers Inc (use of trade marks on the internet; (2000) FSR 697); antiques.portfolio.com v Rodney Finch (copyright in photographs of inanimate objects; [2001] ECDR 5); Vestergaard Frandsen v Bestnet & Others (2007] EWHC 2455 (Ch) (misuse of technical trade secrets). Publications include: author of ‘Pre-emptive Remedies in Europe’ (Longmans 1992); author of many articles in various publications, including ‘Trade Mark World’ and ‘Copyright World’. On the Editorial Panel of ‘World Media Law Reports’ and ‘World Trade Mark Law Reports’.

  • Is comparative advertising unfair?

    THE EUROPEAN COURT OF JUSTICE (ECJ) IS IN THE midst of considering questions referred to it by the UK courts in three separate cases that should clarify the law regarding comparative advertising. This type of advertising, particularly when it identifies a competitor or a competitor’s goods or services by referring to a registered trade mark, is of particular concern to trade mark owners as their competitors normally seek to make unfavourable comparisons with their own goods or services, or to take advantage of being associated with the market leader’s brand.
