The firm: Triay & Triay is a full-service law firm. Corporate and commercial: The firm’s extensively experienced Corporate and Commercial team has a trusted reputation for excellence and the provision of focused and commercially minded specialist advice.  The team provides expert and industry specific assistance across a comprehensive range of company and commercial matters, including mergers, acquisitions and takeovers (in the regulated and unregulated sectors), solvent and insolvent corporate reconstruction and rescue, corporate finance, acquisition and project financings, data protection, information technology and telecommunications, electronic business and commerce (including e-gaming), agency, distribution, franchising and licensing arrangements, EU and competition law, commercial contracts, joint ventures, insolvency, intellectual property and all associated regulatory matters. The Firm regularly assists clients and other local service providers with company re-domiciliation’s and branch registrations.

Dispute resolution: the firm’s experience and expertise is well recognised as a market leader across all spectrums of litigation matters and includes asset tracing/interim remedies in aid of foreign proceedings, company and commercial, contract, construction, criminal, dishonest assistance claims, employment, family, gaming, insolvency (to include insurance companies), intellectual property, judicial review, landlord and tenant, personal injury, professional negligence, trademark infringement and trust litigation.

Employment: The firm’s busy employment department provides a full range of specialist advice and assistance on contentious and non-contentious employment and human resource matters. The department, which includes a Queen’s Counsel and two current Chairpersons of the Employment Tribunal in Gibraltar, boasts considerable experience and acumen and is the sole retained counsel for a number of the largest employers in Gibraltar across various industry sectors. The experienced team has a proven track record of providing responsive, diligent and practical advice in all areas of employment law, and its portfolio includes representation of employees and employers before the Employment Tribunal, advising on and assisting with the management of collective redundancy procedures, termination and recruitment arrangements, international outsourcings, transfer of undertakings, preparation of multi-level employment contracts, staff handbooks, human resource policies, employee compensation, benefit and incentive schemes, harmonisation arrangements and all employment aspects of corporate transactions, insolvency and restructuring.

Financial services: Gibraltar has a strong and thriving finance industry, regulated to EU standards. Our Financial Services team has been at the forefront of this growth and in particular in developing Gibraltar as a jurisdiction of choice for the establishment of investment services and investment funds. This has included contributing to Thomson Reuter’s European Lawyer Reference on investment funds.

The Financial Services team have a wealth of experience in advising banks, payment institutions, Gibraltar investment funds, investment fund managers, investment fund administrators, asset and investment managers/brokers and insurance companies, intermediaries and managers. Our financial services lawyers have advised and assisted with, the initial structuring and restructuring of licensable/licensed entities and ongoing regulatory matters such as licensing, passporting into other EU jurisdictions, the establishment of branches, distribution issues, the re-domiciliation of licensed entities and the disposal of financial services entities. The team has recently been involved in a several multi jurisdiction insurance portfolio transfers.

Fintech:  this team forms part of our traditional financial services team.  The firm’s Fintech team has the experience, industry knowledge and commercial understanding to assist these bold entrepreneurs. Our lawyers have also assisted clients, such as payment service providers, with licensing applications and therefore understand the requirements of the licensing process. The team has leveraged its existing knowledge of traditional financial services to assist clients in understanding their regulatory obligations under Gibraltar’s world-leading Distributed Ledger Technology regulations. The team has assisted numerous clients with establishing and structuring their ICOs from Gibraltar. The team has been actively involved with the drafting of the Token Regulations. The team has contributed to the International Comparative Legal Guide on Fintech .

Private client: the firm provides market leading assistance and advice on individual tax and residence matters; estate planning and administration; associated tax planning issues as well as advising on the establishment and/or administration of non-charitable, charitable trusts, private trust companies and other philanthropic ventures. The firm regularly assists individuals, families, trust corporations, fiduciaries and other professionals from a variety of different backgrounds and cultures in order to provide bespoke solutions to meet the needs of the client concerned.

The firm works closely with its associated company T & T Management Services Limited in providing bespoke solutions to its clients both locally and worldwide.

Property: the property team is growing and innovating to cater for Gibraltar’s developing property market. The team continues to offer specialist advice in relation to residential and commercial property transactions both in Gibraltar and in Spain through the firm’s associated Spanish firm. The Firm also advises both landlords and tenants in the commercial property sphere. Furthermore, the team advises developers in Gibraltar.  The firm advises various charitable institutions in relation to their property matters. The team liaises with the dispute resolution team in relation to property litigation. The team’s experience knowledge and expertise is unrivalled locally with several leading practitioners in the sector.

Shipping and Admiralty: The firm’s shipping and admiralty team has been at the forefront of developing Gibraltar as a jurisdiction of choice for admiralty and shipping work and is recognised as the market leader in Gibraltar. Its reputation is unrivalled. The team has been involved in the majority of mortgagee led ship arrests (including fleet arrests) that have occurred in Gibraltar. The team pioneered the private treaty sale option which has become extremely popular amongst creditors. The team also has a wealth of experience of dealing with Ship Registrations and Financings. The firm also acts as the registered agent for approximately two thirds of all commercial vessels registered in Gibraltar.
