Grette represented German Reinhold Meister in a Norwegian court proceeding against German Bilfinger

Grette successfully defended the German construction company Reinhold Meister GmbH (Deggendorf, Germany) against a NOK 230 million payment claim put forward by the construction companies German Bilfinger Berger SE, Danish Pihl & Søn A.S. and the Norwegian construction joint venture CJV E18 Grimstad – Kristiansand ANS as claimants.

The claim was related to the construction of a 40km long new highway between Grimstad and Kristiansand in Southern Norway. The Norwegian joint venture CJV E18 Grimstad – Kristiansand ANS (held by Bilfinger Berger and Pihl & Søn A.S.) was the main contractor of this highway construction project, whereas Reinhold Meister GmbH as a subcontractor was responsible for substantial parts of the earth and road works. The construction projects led to a loss of around NOK 1.2 billion (around EUR 150 million) for the main contractor. The claimants argued that Reinhold Meister GmbH was liable to cover this loss with an amount of up to NOK 230 million (around EUR 29 million). After a two-weeks hearing in the local court of Kristiansand as the court of first instance, the court dismissed the claim on its merits. The judgement will become legally binding after expiration of a one-month appeal period.
