At the end of October 2007, Loyens & Loeff presented an overview of recent Benelux fund developments. The Netherlands and Luxembourg have further improved their competitive fund climate. Loyens & Loeff opens office in Dubai
Loyens & Loeff N.V. (attorneys, tax lawyers and civil law notaries) will open an office in Dubai (United Arab Emirates) on 1 January 2008. This makes Loyens & Loeff the first continental-European legal and tax service provider to take such a step.

Ruud Lubbers guest of honour at Loyens & Loeff's book presentation
On Thursday 30th November, in the presence of about 100 invited guests, a mini symposium took place at Loyens & Loeff's Amsterdam office. The theme of the event was corporate social responsibility (CSR) [or in Dutch, maatschappelijk verantwoord ondernemen (MVO)]
During this symposium, the book 'Een wereld te winnen' ['A world to be won'] was presented. The book is the initiative of Tineke Lambooy, a lawyer and PhD student. It contains interviews with CSR experts active in the world of politics, science, business and social organisations, all of them describing their vision of CSR.

A given moment in time
Guest of honour at the meeting was former Prime Minister Ruud Lubbers. He received the first copy of the book from Chairman Pim Bertels. Lubbers sees the publication as very valuable due to the variety of perspectives on CSR described within. He says: 'It's a very special book and rather like a photo album, it describes a given moment in time for a current topic that is changing rapidly.'
In the book, Ruud Lubbers describes 'The Earth Charter'. This Charter is a universal text in which worldwide accepted values are recorded as regards durable development and a decent existence. The Charter argues for 'a celebration of life'.
The book 'Een wereld te winnen' (only in Dutch) will be available in bookshops from 1st December. 'We are hoping to provide a contribution towards a growing consciousness of corporate social responsibility', says Pim Bertels, Chairman of Loyens & Loeff. 'Only once everyone starts thinking about solutions to keep our world liveable, can we offer a decent environment to our following generations.'

Loyens & Loeff once again the 'Benelux Law Firm of the Year'
For the second time in three years, Loyens & Loeff has been chosen as 'Benelux Law Firm of the Year' by Chambers and Partners. During the annual Chambers Global Awards Gala, held 16 November at the Hilton Hotel on Park Lane in London, chairman Pim Bertels received the award on behalf of Loyens & Loeff. The prestigious Chambers Award was also presented to Loyens & Loeff in 2004.
Belgium in joint 5th place with the Netherlands as a top destination for Chinese investors -
Belgium, jointly with the Netherlands, are among the countries that most appeal to Chinese companies seeking to expand abroad. Both countries are among the top 5 countries of interest to Chinese investors, together with Germany, France and Italy. However, the downside is that Belgian companies are mainly focusing on investing in China and not sufficiently on the potential of Chinese companies to invest in our country.

A swifter, more balanced approach to bullying in the workplace
The new Anti-Bullying Act tackles undesirable behaviour at an earlier stage. A more neutral approach results in a faster and better solution. The new bill not only implies a major improvement for victims, it allows employers to play an active role. Moreover, misuse of the law is more difficult under the new regulation. Loyens informed of the regulation in detail during a seminar on 27 June 2006.
One in every seven employees will find themselves confronted with undesirable behaviour at the workplace at some stage of their career. Many employees have difficulty taking the step towards improving their situation within the scope of the current statutory framework. Many companies do not have an internal mediator whom employees can approach with their complaint. This leaves the employee no alternative but to turn to external prevention advisors or a court of law. And this, it turns out, is too big a step.
Katrien Berghs and Filip Saelens, employment law specialists at Loyens, found that in many cases this leads to only the most assertive of employees making their complaints public while many victims are left out in the cold. Current regulation also allows too much opportunity for misuse of the procedure.
The new bill will oblige companies that have at their disposal an external prevention advisor and want to appoint a mediator to select this candidate from within their own organisation. This is done in an effort to encourage employees to come forward with any grievances at an earlier stage so that these can be solved without the need for submitting an official complaint.
The bill by the Minister for Employment and eGovernment, Peter Vanvelthoven, foresees a significant increase in the role of the mediator in managing undesirable behaviour at the workplace. This will subsequently relieve the prevention advisor who will then be able to devote greater attention to the preventive strategy.
