Position

David is a Partner at Hassans and a member of the firm's Litigation team

A highly regarded litigator, David has nearly 37 years’ experience advising and appearing as Counsel within a wide range of litigation. He undertakes all forms of commercial litigation as well as insolvency, fraud, banking, defamation, trust disputes, compliance and regulatory work, environment and planning, and crime.

In the field of commercial litigation he successfully acted in a case involving a very high-profile personality both in the Supreme Court and the Court of Appeal for Gibraltar. He was the first to obtain in Gibraltar a common law production and disclosure order against a third party bank and has conducted substantial cross-border litigation, as well as international joint venture claims and minority shareholder disputes. He continues to advise and act in cases involving jurisdiction and applicable law issues as well as cross-border enforcement of judgments. He has acted for creditors, secured and general, liquidators and troubled companies in the field of insolvency. He has maintained membership of the International Insolvency Institute for some years and was involved in the comprehensive and radical reform of Gibraltar’s Insolvency laws. He acts in trust disputes and funds litigation.

Also he secured for the Times Newspapers Limited the early dismissal of a libel action at the end of a lengthy litigation campaign. He has also built a substantial financial services compliance and regulatory practice, dealing also with data protection issues. He is the partner for over 12 years handling the firm’s pro bono representation of Gibraltar’s principal environmental NGO, regularly advising and taking a public role on high-profile issues. His criminal practice is mainly, but not solely, white-collar crime.

Career

He has served as Chairman of the Industrial Tribunal and has contributed to a number of key publications. These include the Gibraltar chapter of “International Execution of Judgment Debtors”.

David is Chairman of the Gibraltar Bar Council as he was between 2009 and 2012. He represents the Bar on the Finance Centre Council. He also serves on the Supreme Court’s statutory Admissions and Disciplinary Committee for barristers and solicitors.

He remains Chairman of the Duke of Edinburgh’s International Award Gibraltar since 2001.

Education

David attended school in Gibraltar and in Plymouth, Devon. Graduating in law from Exeter College, Oxford University in 1980, David read for the Bar finals at the Inns of Court School of Law in London and was called to the Bars of England & Wales, and Gibraltar, in 1981. David joined Hassans at the time, becoming a partner in 1987, taking on the creation and development of the litigation practice to the full service that it is today. He was appointed Queen’s Counsel in 2002.

Leisure

His more active interests are those of an amateur pianist and guitarist and regular physical exerciser on the roads and in the gym.

The full-service disputes team at Hassans is experienced in international litigation as well as insolvency and negligence cases. Practice head Lewis Baglietto QC is well regarded and leads a team that includes David Dumas QC, who specialises in insolvency work and white-collar crime investigations and disputes; public and commercial expert John Restano QC, who also has significant expertise in trust disputes; and Anne Rose, who is active in high-profile trusts and repossession matters. Also notable are commercial and multi-jurisdictional litigation expert Michele Walsh and experienced associate Moshe Levy. The firm acted for Ansaldos Townhouse in a dispute with developer Sharrok Shand concerning a matter that the latter wanted referred to adjudication.
