It is indubitably a universal knowledge that persons with disabilities, as a socially vulnerable stratum, need special treatment and special attitude.  Kazakhstan, like many other countries, legislatively provides for the key guidelines to give the disabled a special attitude of society and ensure the minimum guarantees to which they are entitled.  The state is also establishing special requirements to, and conditions of, disability labor, however, in practice, not all employers know their corresponding obligations.  This is why we are going to dwell on the key legislative requirements relating to disability labor.

On 1 January 2016, Kazakhstan enacted its new Labor Code, which, among other things, altered the procedure for the review and settlement of individual labor disputes.  Now, before going to court, the employer and the employee must have their individual labor dispute reviewed by a special body – conciliation commission.

LEASED LABOR [1] IN KAZAKHSTAN: HAS THE NEW LABOR CODE LEGALIZED IT?

As business globalizes, different forms of the leased or so-called atypical labor are going increasingly popular, which cannot be neglected.  Whilst not disapproving of this phenomenon in principle, Kazakhstan's labor law, unfortunately, does not always flexibly respond to messages from economy.  This is normal athough, as any law is essentially conservative.

There exist several different options of leased labor: outstaffing, outsourcing, etc.  The most popular type of leased labor is the so-called secondment – temporary transfer of employees by an employer to another employer.

PROBLEM ISSUES OF PERSONAL DATA LOCALIZATION

The issue of proper processing of personal data has gone topical for Kazakhstanis and companies operating in Kazakhstan after the special Personal Data Law[1] had been adopted in 2013 to establish the key requirements in this area of legal relations.  Certain practices have formed over the three years that this Law has been in effect, and all companies keen on complying with the legislation have generally organized their activities in such a manner as to meet the Law requirements.  Meantime, starting 1 January 2016, the currently effective personal data storage procedure has been amended, specifically, adding a requirement to localize the bases containing personal data (hereinafter, the "bases") in Kazakhstan.
