The ‘very knowledgeable’ team at Beachcroft represents major insurers including Aviva and Zurich Insurance, and in 2010 made significant changes to its claims department, creating 11 specialist product lines including credit hire and strategic litigation. Associate David Williams is ‘very impressive’, and Ruth Winterbottom, who leads the team, is ‘excellent in both the regulatory field and with civil claims’ and ‘a very safe pair of hands’.

Senior partner Chris Coughlin leads the defence team at Berrymans Lace Mawer LLP, which advised a significant number of uninsured companies in 2010. Aviva and Leeds City Council are also clients. Roy Woollard has ‘good knowledge of failure-to-educate matters’.

DWF LLP bolstered its team in 2010 with the addition of five new members to its catastrophic injury team, and was appointed to the QBE catastrophic injury panel. Other clients include Aviva and Faraday. Head of department Glyn Jones is recommended.

Ford & Warren’s team, which is ‘excellent’ and ‘very professional and pragmatic’, advises on road traffic accident and sports injury claims, and regularly works on high-profile cases. Blaise Smith, who leads the team, ‘provides first-rate legal analysis’.

The service level at Gordons LLP is ‘excellent at all levels’. The team, led by Rachel Hudson, won first-time instructions from a major insurer in 2010, and the Otto Group and Wm Morrison Supermarkets are also clients. Duncan Brockway is recommended.

Plexus Law regularly defends high-value cases, and is instructed by insurance companies, individuals, professional bodies and public authorities. Joint senior partner Andrew McDougall leads the team in Leeds.

The ‘very good’ team at Forbes received instructions from new client Asda in 2011. Managing partner Siobhan Hardy, who leads the team and specialises in employers’ liability and disease claims, has an ‘excellent level of knowledge’.

  • COUNCIL TAX

    In Harrow LBC v Ayiku [2012] EWHC 1200 (Admin) Sales J held that the word “or” in the Council Tax (Exempt Dwellings) Order 1992, art 3 Class N, had a disjunctive meaning, therefore it was sufficient for the non-British spouse of a foreign student to satisfy one or other of the two conditions, namely being prevented from taking paid employment or being prevented from claiming benefits, in order to qualify as a “relevant person” who was exempted from liability to pay council tax.

    In R (Calver) v Adjudication Panel for Wales [2012] EWHC 1172 (Admin) Mr Calver was a member of Manorbier Community Council who successfully challenged the decision of the Panel to dismiss his appeal against a decision by Prembrokeshire County Council Standards Committee censuring him for a number of comments or blogs posted by him on a website he owned and controlled.

  • Judicial Review

    The Judgment of Lindblom J in The Manydown Co Ltd v Basingstoke and Deane BC [2012] EWHC 977 (Admin) repays attention. The Claimant sought to challenge by judicial review 2 decisions of the Council: (1) the Council’s refusal to reconsider its position on the development of a site that it owns (and is the subject matter of a Joint Development Partnership Agreement with the Claimant); and (2) a decision of the Council’s Cabinet approving a selection of sites for development which did not include this site.

    After its torrid passage through Parliament, the Health and Social Care Bill received Royal Assent on 27 March 2012. The Act deals principally with healthcare reform, but it also contains some amendments to the legislative framework for social care. It will come into force on a day yet to be appointed by the Secretary of State.
