The patents team at Bird & Bird is hailed for ‘its expertise and knowledge of the sector’. Manuel Lobato leads the experienced group of which Antonio Cueto and Raul Bercovitz are also key members. The team successfully advised B. Braun Melsungen in a patent infringement claim against the exclusive distributor (in Spain) of a product manufactured by an Indian corporation and is now representing the client, as defendant, in a patent nullity action initiated by the same Indian manufacturer.
The ‘prestigious and knowledgeable’Miquel Montañá leads the patents practice at Clifford Chance which handles an impressive number of patents claims for clients in the pharmaceutical sector. It is advising Pfizer in a multijurisdictional case concerning the enforcement of a second medical use patent (which protects new therapeutic uses for known ingredients).
Elzaburu handles an impressive number of patent prosecution, infringement and nullity actions before the relevant Spanish and international authorities. Key team members include Antonio Castán, Enrique Armijo and Colm Ahern; clients include Abengoa, Ferrovial and Rovi.
Gómez-Acebo & Pombo Abogados’ patents practice has been very active of late, acting for clients on some of the most relevant pharmaceutical claims both domestically and abroad. In an on-going mandate, it is acting for Actelion Pharmaceuticals in a cross-border dispute with a major US pharma corporation and concerning a well-known drug. Eduardo Castillo, head of the IP and IT practices; and Jesús Muñoz-Delgado, head of the patents team, are both noted.
Boutique firm Grau & Angulo advises on highly complex mandates. Headline work included successfully advising Liquats Vegetals (and others) on a patent challenge filed by Oatly and concerning alleged infringement of a product-by-process patent; after an appeal the case was decided in favour of the client. Jorge Grau and Alejandro Angulo are both recommended.
The patents team at Herrero & Asociados is commended for ‘the technical quality of its work and quick attention to clients’ queries’. Recent mandates saw the team advise Levikurve regarding the invalidity of a patent. Other clients include ZTE Corporation, LinkedIn and Repsol. Head of litigation José Luis López is the key name.

Recent work highlights include acting for Bayer in a claim related to alleged patent infringement and also a patent nullity case concerning a veterinary health product. Abril Abogados, SL advised Faurecia in two (related) patent-litigation claims against Benteler, concerning the infringement of its patent protecting cockpit elements; the court upheld the clients’ claims. Carlos González and Ignacio Temiño are names to note.
A young boutique, Balder has won respect for its work in the patents area. Patricia Koch and Miguel Aznar are the key names and recent matters saw the team act for China’s Haier Telecom in several related patent claims across Europe. In other work it advised Icare Finland on a patent infringement dispute connected to the importation of Chinese products, and Fundación Azti regarding a claim for the co-ownership of a European patent.
Cuatrecasas provides ‘innovative and specialised assistance from licensing to patent prosecution’. Albert Agustinoy heads the practice and Jorge Llevat and Enrique Sánchez-Quiñones are also noted.
Garrigues’ experienced and specialised team, led by Carolina Pina, receives praise for its approach to IP instructions. The practice advised Ferring on patent litigation related to a generic medical product for which EU market-entry was sought prior to the expiration of the client’s patent.
Hoyng Rokh Monegier is well known for its expertise in patent litigation. The team successfully represented Spanish manufacturer Gamesa in its appeal in a patent dispute with the founder of Enercon. Luis Fernández-Novoa is recommended.
