Cuatrecasas provides a full-service model to the industry, acting for large Spanish clients such as Deoleo as well as international companies including Haribo. The 50-lawyer team recently acted for Casademont (now part of Piensos Costa) on its €25m debt refinancing. On the employment side, it assisted Heineken with its drafting of a new collective agreement as well as with contentious matters. Public procurement counsel Jorge Botella advises multinationals on labelling, presenting and advertising food products; Pere Kirchner is the corporate partner experienced in the sector.

Garrigues’ ‘very good’ practice stands out for its ‘business understanding’ and ‘flexibility, which means it can achieve realistic deals that bring value’. The firm provides advice on all legal and tax matters concerning production and distribution chains to key industry clients such as Lactalis, Bimbo and Mondelēz; it also works with well-known supermarkets and food retailers. Recent highlights included assisting the majority shareholders of Grupo Vips with its change of investment shareholder (ProA Capital acquired a 30% equity stake). The ‘very experienced’ team at Gómez-Acebo & Pombo is involved in all industry matters from food chain issues to compliance, taxation and M&A, offering ‘business-oriented advice and an ability to find effective solutions’. Eduardo Geli recently led on acting for a bank syndicate headed by BBVA on the €93.6m restructuring of Lacrem (now Farga Group). The firm is particularly active in cross-border deals in the Americas, assisting the sellers with Grupo Palacios’ $20.7m purchase of Florida-based Elore Holdings.

Baker McKenzie acts for key industry names such as Unilever and Mondelēz through its multidisciplinary group; IP partner Cristina Duch and employment partner Mireia Sabaté have particular experience in the sector. Clifford Chance is, according to one client, ‘among the best firms to work with’ due to its in-depth understanding of industry developments. Group head Miquel Montañá is well regarded in the industry and is noted for his ‘knowledge of complex subject matters and ability to retain excellent experts and extract the most relevant arguments’ with respect to patent litigation. On the competition side, the firm recently advised Pfizer on Spanish merger control proceedings regarding its $1bn sale of Hospira Infusion Systems to ICU Medical.

Uría Menéndez provides a comprehensive service to healthcare sector clients, covering complex commercial and contract law matters, public procurement and privacy as well as regulatory and competition advice. Well-respected industry expert Teresa Paz-Ares heads the 13-strong group, which is noted for its ‘exceptional skill and performance’; IP partner Montiano Monteagudo is the contact in Barcelona. Paz-Ares and public law partner José Miguel Fatás recently led advice to Johnson & Johnson on its termination of a long-standing licence and distribution agreement with Esteve regarding Fortasec. Baker McKenzie’s team stands out for its ‘flexible and practical approach and knowledge of the sector’, particularly with respect to regulatory and competition matters. Pharmaceutical industry experts Montserrat Llopart, managing partner of the Barcelona office, and Madrid-based Cecilia Pastor are the practice co-heads. The firm recently advised Chiesi on its acquisition of market-leading diet product Lipograsil from Zambon.

Bird & Bird is particularly strong in IP law, where it has ‘an extraordinary specialisation’ in the area. Raquel Ballesteros leads on regulatory matters while ‘incisively analyticalManuel Lobato heads the patents side. Notable recent work includes representing Chemo Group (now Insud Pharma) in patent infringement litigation.

With more than 30 lawyers, Cuatrecasas has industry specialists across a range of practice areas. IP partner Jorge Llevat and public law and litigation expert Jorge Robles, who jointly head the department, are leading advice to Ipsen on contractual, regulatory and IP issues as well as on advertising matters.

Faus & Moliner is a well-known boutique in the sector with particular expertise in providing regulatory advice to pharmaceutical clients. The Barcelona-based firm draws its strength from the vast experience of name partners Jordi Faus and Xavier Moliner.

Garrigues has a multidisciplinary practice; recent highlights include acting for Aegon on the sale of its clinic QMS to Quirónsalud. Corporate partner José Fernández-Rañada and IP partner Carolina Pina are the practice heads.

Gómez-Acebo & Pombo has ‘a strong team of lawyers and is extremely effective in litigation cases’. The firm is known for its IP advice; Eduardo Castillo heads the group, which recently acted for Bristol-Myers Squibb and Ono Pharmaceutical on a multibillion-dollar patent infringement case against Merck & Co concerning cancer drug Keytruda. The firm also assists GSK with advertising matters and commercial contracts.

Well-respected boutique Jausas’ strength lies in its regulatory and compliance services to the sector; the firm is also active in the competition and advertising spaces. Practice head Héctor Jausàs and senior associate Gemma Colomer are the key contacts.

RCD - Rousaud Costas Duran specialises in drafting biotechnology agreements and has extensive expertise in data protection with respect to laboratory treatments; it is particularly active in the start-up space. Ignasi Costas heads the innovation and entrepreneurship department, which is strong in regulatory matters.

DLA Piper LLP provides ‘proven industry and procedure knowledge and technical support’. Department head Diego Ramos recently led advice to West Pharmaceutical Services on the privacy implications of its research activities in Spain. Other clients include Chemo Group (now Insud Pharma).

Patent and product liability expert Kiko Carrión heads the team at Eversheds Sutherland Nicea, which is strong in IP law. The firm works with international pharmaceutical giants and Spanish companies; it is also experienced in corporate and regulatory matters.

Hoyng Rokh Monegier is particularly active in cross-border patent litigation with a multinational team that provides advice from a European perspective. A notable highlight includes representing Intervet (now Merck Animal Health) in patent infringement proceedings against Boehringer Ingelheim concerning a vaccine. Managing partner Luis Fernández-Novoa is the key contact; Álvaro Velázquez is ‘effective’.

Baker McKenzie is strong in transactional advice, acting for Mercedes-Benz owner Daimler on its €1.1bn acquisition of Athlon Car Lease and its subsidiaries. The firm is currently representing Honda in competition-related proceedings before Spain’s Supreme Court. Key names include corporate partner Jorge Adell and employment expert Mireia Sabaté.

The impressive multidisciplinary group at Cuatrecasas is particularly experienced in industry M&A. On the contentious side, the firm is representing Basque heavyweight Bascotecnia Steel in an ICC arbitration concerning €175m in claims relating to an Algerian rolling mill. Recent high-profile deals include advising Springwater Capital on its divestment of Unipapel France and Morocco to Envel’Offset.

Mónica Martín de Vidales and Felipe Martínez Caballero led advice to PSA Group Peugeot on its €2.2bn acquisition of Opel and Vauxhall from General Motors. The team recently advised Panasonic on its acquisition of a controlling interest in automotive parts manufacturer Ficosa International. Recent highlights included acting for Uvesco Group on its purchase of the production unit of supermarket chain Gigante (now BM Supermercados). Eversheds Sutherland Nicea provides ‘value for money and on-time advice’. Highlights included defending Sony and Kobalt in a plagiarism claim concerning Shakira’s hit song La Bicicleta. Vicente Arias leads advice to Microsoft on data retention periods and is assisting OpenText with the drafting of data processing arrangements and a privacy policy review.

Hogan Lovells International LLP acts for well-known industry names, handling matters from data transfer and compliance advice to IT outsourcing, software rights and cloud computing issues. Gonzalo Gállego heads the team.

Linklaters is well-respected in the telecoms sector; José Giménez is leading advice to Telefónica on regulatory matters and to BT on legislation relating to the monitoring and prevention of malicious communications.
