At Allen & Gledhill LLP, new practice head Edwin Tong advised a syndicate of creditors in relation to the restructuring of maritime transportation company BLT Group, and advised a syndicate of nine banks in the provisional liquidation and restructuring of Fibrechem Technologies, involving claims in excess of $90m. Andrew Chan and Edward Tiong represented international bookstore chain Borders in an application for judicial management during its restructuring process.

Drew & Napier LLC’s insolvency and restructuring practice stands out for its regional focus and cross-border expertise. Julian Kwek (‘a master of corporate strategy’) advised Sawit Mas Group on the restructuring and disposal of various plantation companies with a total debt value of $160m. Kwek and fellow co-head Sushil Nair also advised on the worldwide debt restructuring of ship cargo transportation company PT Berlian Laju.

With ten specialist partners, Rajah & Tann LLP houses one of the largest dedicated restructuring and insolvency practices in Singapore. Andre Yeap SC acted for the liquidators of MF Global Singapore in its high-profile insolvency. Group head Kwan Kiat Sim advised one of the major lenders and a number of unsecured creditors in the PT Berlian Laju Tanker Group matter, and Eng Beng Lee SC successfully represented TT International in the Court of Appeal. The team continues to assist the liquidators of various Lehman Brothers entities across Asia.

Shook Lin & Bok LLP’s team of ‘approachable lawyers’ is rated for its ‘sound industry knowledge’ and ‘quick response times’. Sarjit Singh Gill SC advised the coordinating bank group on the proposed restructuring of Drydocks World, in a matter valued at $2.2bn. Danish company Torm Shipping and Armada (Singapore) also instructed the firm.

Chou Sean Yu, Manoj Sandrasegara and Mark Choy lead the team at WongPartnership LLP. It acted for Tiger Airways in its proposed subscription in Mandala Airlines, with an unsecured debt value of S$347m; and represented New Lakeside Holdings in its application for a judicial management order.

At Rodyk & Davidson LLP, Lawrence Teh provides bankruptcy protection and restructuring advice to local and foreign banks, insurers and public and private sector medical operators.

The ‘very versatileTan Chuan Thye heads the team at Stamford Law Corporation, which acted for Deloitte & Touche as liquidators in the provisional restructuring of Hongwei Technologies. Justin Yip joined from Baker & McKenzie.Wong & Leow in July 2011.

TSMP Law Corporation’s Ashok Kumar acted for a group of ex-senior employees of MF Global Singapore, and assisted First Engineering Limited on its proposed restructuring involving $67.8m worth of syndicated term loans.

  • MYANMAR’S FOREIGN INVESTMENT LAW 2012: A SHORT COMMENTARY

    On 2 November 2012, President Thein Sein signed into law Myanmar’s new Foreign Investment Law (the new FIL), replacing the previous Union of Myanmar Foreign Investment Law of 1988. Pursuant to the new FIL, the Foreign Investment Rules and the Classification of Types of Economic Activities Notification (collectively, the Rules) were published on 31 January 2013. The Rules provide further guidance on the new FIL by expanding upon the rights and duties of foreign investors under the new FIL, as well as clarifying the types of activities for which foreign investment is prohibited or restricted.

    On 10 April 2013, the Competition Appeal Board (CAB) dismissed all but two grounds of appeal by five modelling agencies that had been found by the Competition Commission of Singapore (CCS) to have engaged in price-fixing activities.   • Consultation on the recommendations of the Financial Advisory Industry Review

    On 26 March 2012, the Monetary Authority of Singapore ("MAS") announced the launch of the Financial Advisory Industry Review ("FAIR"), with the aim of raising standards of practice in the financial advisory ("FA") industry and improving efficiency in the distribution of life insurance and investment products in Singapore. Subsequently, a panel, chaired by MAS and comprising representatives from industry associations, consumer and investor bodies, academia, media, and other stakeholders ("FAIR Panel"), was formed on 2 April 2012 to conduct the review.

    The Computer Misuse Act has been renamed the Computer Misuse and Cybersecurity Act. The name change is only the first sign of the myriad of changes within the body of the Act, with new provisions giving the Government “sweeping powers over cyberspace”.   • Mexico joins the Madrid Protocol

    In November 2012, Mexico deposited its instrument of accession to the Madrid Protocol for the International Registration of Marks (“Madrid Protocol”) with the World Intellectual Property Organisation (“WIPO”), the body administering the Madrid Protocol. The treaty will enter into force with respect to Mexico on 19 February 2013. Mexico is the third Latin American country, after Cuba and Colombia, to join the Madrid Protocol.
