CMS Grau advises on all aspects of urban and rural land matters, from development, construction and acquisitions through to administrative procedures and dispute resolution. Instructions range from shopping mall development, to land rights disputes in the energy and mining sector, for example. The firm acted for supermarket chain Hipermercados Tottus on a series of key acquisitions across the country, totalling $13.5m, and represented Sun Dreams on the $26m acquisition of Fiesta de Miraflores Casino (and three other properties) from Thunderbird Resorts. Land rights matters included advice to Tahoe Resources Perú on the rights regarding La Arena and Shahuindo gold mine projects, involving 600 properties. Following a competitive pitch, the firm was selected to advise government road agency Provías Nacional on land acquisition and remediation for four road infrastructure projects. The 20-strong, specialist department is led by Raúl Ravina and Carolina Gajate. Franco Soria was promoted to partner.

Real estate boutique Estudio De la Flor, García Montufar Arata & Asociados is ‘the best and most specialised in real estate issues’, ‘very detailed in its analysis’ and ‘knows the industry very well’. It fields four partners and 14 associates all specialising in a broad range of matters, with a particular focus on solving complex land issues. Guillermo García Montúfar heads the practice, supported by Moisés Arata, highlighted for his ‘great experience and analysis’, ‘very good’ Claudio Berastain Quevedo who is ‘one of the leading lawyers specialising in real estate’ and Julio Salazar. A bulging caseload includes advice to Grupo Auna on the $100m construction of Clinica Delgado in the district of Miraflores, Lima; advising Cementos Portland on the acquisition of land from Community of Llanavilla to build a new cement procession plant; and acting for GTC Proyectos Inmobiliarios on two condominium housing developments in the Chaclacayo district, a mandate complicated by the presence of an archaeological site on the land.

A top player in the market’, Miranda & Amado has ‘tons of experience in real estate’ and handles some of the largest transactions and developments in the country. Clients highlight the team’s knowledge, fast response times and personalised attention and include those drawn from the energy, mining and infrastructure sectors, as well as developers, investors, real estate funds and acquirors. Recent instructions include advising Terranum Capital Latin America Real Estate Fund on a significant housing development, with projected investment of $400m; and acting for new client H&M Hennes & Mauritz on all its commercial premises and new projects. Contentious work includes acting for beauty retailer Cetco, a subsidiary of Belcorp, in a real estate dispute concerning 5,500m² of property in Lima. The very experienced Claudia Lucena heads the practice and stands out for her ‘appropriate answers’ and ‘ample knowledge of the real estate business in all phases’.

Rodrigo, Elías & Medrano – Abogados advises some of the largest players in the market, such as investment fund manager AC Capitales SAFI, which it has advised on approximately $92m in real estate investments in the country; Tahoe Resources Perú, which receives ongoing advice to facilitate the expansion of its Shahuind gold mine; and Viva GyM, which the firm is advising on the development of 11,100 houses which will be sold through social programs. More novel instructions include acting for Inversiones La Maddalena on the construction of a marina comprising jetty, sea hotel, aquarium, funfair and waterwheel and requiring the acquisition of rights over land and sea. The department is led by Carlos Carpio, one of the most recognised and respected lawyers in the sector, with support from the versatile Hugo Silva who is noted for his construction knowledge. Martín Mejorada has left the firm.

Lazo, De Romaña & CMB Abogados receives great praise from clients for its ‘excellent level of service’ which ‘always goes the extra mile’ and lawyers who are ‘always there when we needed information or their presence’. Clients also cite the firm’s industry knowledge and commercial approach that ‘never forgets the bigger picture’. A quality client list includes Compañía Minera Zafranal, developer Inversiones Centenario and petrol pump chain Grupo ABG. Head of practice José Antonio Jaramillo is ‘objective, gives clarity and finds solutions when things get complicated’. Stand out senior associate Luis Aliaga is ‘very intelligent, diligent and responsive’.

Estudio Olaechea has ‘a lot of experience in solving the most difficult issues’ and is ‘always available in the face of urgent problems’. The firm provides a very comprehensive offering to significant players in the sector, such as developer Akko Group, real estate investment fund W Capital SAFI and construction distributor Cosmoplas Peru. Head of the practice Rossana Natteri is an ‘excellent conciliator and good negotiator’ and was recently promoted to equity partner. A strong associate bench includes Daniel Amiel and Alberto Meneses who are ‘experienced attorneys, who provide simple and quick solutions’.

Leading infrastructure firm Philippi Prietocarrizosa Ferrero DU & Uria has valuable expertise in general land and real estate matters, where Manuel Ugarte, who strikes a ‘good balance between the pure legal approach and pragmatism’, Jorge Reátegui and Luis Peschiera are all recommended. A diverse caseload includes acting for the investment vehicle for the joint venture hotel project between Inverko SAC and Atton for a $50m mixed-use hotel in Miraflores; and representing developer Inversiones Vicca Verde on acquisitions for the development of a $4m residential project in the Barranco district.

Highly recommended for real estate issuesEstudio Echecopar member firm of Baker McKenzie International is noted for its ‘focus on the client’, ‘vast empirical knowledge’ and ‘good, professional level of service’ which is described as ‘very agile’. Recent matters include advising key client real estate investment fund Fondo de Inversión en Bienes Raíces Larraín Vial – Colliers II (FIBRA II), on the $48m purchase of 62,000m² of sought-after industrial land in the Callao region. At the helm is real estate financing specialist Marco Alarcón. However, the practice group suffered a significant blow with the departure of highly-regarded former practice co-head Eduardo Barboza who, along with key senior associate Jaime Miranda moved to boutique firm Amprimo & Flury Abogados in late August 2018.

Excellent in all respects’, Muñiz, Olaya, Meléndez, Castro, Ono & Herrera Abogados offers a ‘highly efficient’ and ‘very personal’ service. Quality instructions and clients include representing Corporacion Zolla on the acquisition of land for a new state-of-the-art city outside Lima comprising housing, shopping, hotels and hospitals, among other features; and acting for Graña y Montero on the $20.46m transfer of one of its corporate buildings to Chile’s BP Capital. The key partners are Yuri Vega, who is ‘is always available to meet clients’ requirements’ and Fernando Babarczy, ‘the best lawyer in land issues throughout the country’.

Rubio Leguía Normand advises on high-profile matters of significant public interest, for example, acting for Asociación Los Andes de Cajamarca on its Bellavista project to develop housing and improve living conditions in deprived parts of the Cajamarca Region; and advising Minera Yanacocha on its Los Eucaliptos project to construct urbanisation for Yanacocha’s workers as part of its social responsibility agenda. Interbank, Cinemark del Perú and Minera Barrick Misquichilca are clients. The firm is praised for its ‘knowledge of the industry and a very solid multidisciplinary team’ which is led by consistently recommended principal associate Carolina Sáenz.

Arbe Abogados has a focused practice, advising a number of specialist players in the real estate market including Promotora Inmobiliaria Monterrico, V&V Desarrollo Inmobiliario, Illusione Constructora e Inmobiliaria and Inmobiliaria Pionero Dos, all recent client gains. Work typically includes significant-value property acquisitions and development projects. Francisco Gálvez is the key contact and leads a small but ‘very clever and professional’ team that ‘knows our market’ and whose lawyers ‘are there when we need them’.

DLA Piper Pizarro Botto Escobar receives a steady flow of instructions, with a particularly strong following among construction companies. The team acted for Maragogi, opposite Philippi Prietocarrizosa Ferrero DU & Uria, on obtaining $10m finance from Banco Sabadell for the construction of a 137-room hotel on San Isidro. The practice also advised Constructora Cumbres and Machiels Peru on the acquisition of two major social housing projects, as part of a corporate acquisition from Constructores Iberoamericanos, advised by Rodrigo, Elías & Medrano – Abogados. Hernán Velarde leads a team that now benefits from the infrastructure expertise of recent hire Jorge Córdova Benavides from Miranda & Amado.

Clients at Hernández & Cía. Abogados appreciate the firm’s ‘in-depth analysis of the cases entrusted to them’, its responsiveness, attentiveness and ‘ability to adapt to the client’s requirements.’ The practice now benefits from the land law capability of its new mining team hired from Osterling Abogados, comprising partners Luis Felipe Huertas del Pino and Miyanou Dufour and three associates, all with real estate capability. Of the new recruits, senior associate Angela Salazar is praised for her ‘specialised knowledge of real estate law and regulations and ability to find solutions’. The firm advised Condominios Ecológicos Asia del Campo on the acquisition of a 280,000m² plot for a condominium development in the Asia district of Lima.
