With one of the country’s leading dispute resolution practices, Estudio Jurídico Gross Brown’s nine-strong team excels at commercial and civil litigation as well as arbitration and mediation. Recent mandates saw the team assist BBVA Paraguay with several claims against Frigorífico San Pedro related to the foreclosure of $18m-worth of promissory notes; and defending an oil-and-gas exploration-and-production company against compensatory damages claims related to the termination of an exclusive distribution contract. ADM Paraguay, GNB Bank Paraguay and Ericsson del Paraguay feature on the client list. Raúl Andrada Nogués heads the practice group, which also includes associate Fernando Marecos, who specialises in contentious administrative proceedings.

Fast, reliable and very professionalMoreno Ruffinelli & Asociados handles the full array of commercial disputes, including shareholder disputes and breach of contract claims, as well as labour litigation and white-collar crime matters. The firm also has a reputable arbitration practice. Led by ‘outstanding’ José Moreno Ruffinelli and Raúl Fernando Barriocanal, the group is currently representing Compasa, as claimant, in an $18m breach of contract compensation claim against Petroleos Brasileiros and Petrobras Distribuidora – the case has gone to the Supreme Court; and defending Maersk Line against damages claims related to an alleged loss of goods during the transfer from a sea vessel to a river vessel. ‘Exquisite’ attorney Diego Moreno Rodríguez, who comes ‘straight to the point’, is another key advisor and Roberto Moreno Rodriguez adds further strength following his return to the office having served as Paraguay’s Attorney General.

The eight-partner dispute resolution practice at Olmedo Abogados has a tremendous reputation for its expertise in contentious banking-and-finance matters and handles debt collections for heavyweights such as Banco Regional. Currently, José Ignacio Olmedo is representing Puma Energy Paraguay, as claimant, in a $5.6m compensation claim against Transicar regarding the alleged breach of a gas purchase contract; and defending Petrolera San Antonio against the annulment of property claims brought by a group of landowners. The practice group acts for a diverse client base, including Caterpillar Leasing Chile, Syngenta, Veritex and El Sol del Paraguay. Gustavo Olmedo is a well-established figure in the market.

Dispute resolution is a traditional mainstay for the Estudio Riera Abogados where the 11-strong department represents a wide range of domestic and international high-profile clients in commercial and civil proceedings. The firm also has an impressive presence in the arbitration sphere, leveraging off the excellent reputation of Manuel Riera Escudero, who is a member of the Paraguayan Arbitration and Mediation Centre (CAMP). Other names to note are Sebastián Quevedo and Manuel Riera Domínguez.

Very goodVouga Abogados is ‘one of the first, go-to firms’ for clients seeking ‘sound legal advice’ on the full array of corporate and commercial litigation, including debt recovery, contractual and tort, distributorship, and franchising and licensing disputes, as well as contentious matters related to IP, tax, labour, banking and regulatory issues. Recent mandates saw practice head Mirtha Dos Santos represent ADM Paraguay in a lawsuit challenging a fine imposed by the Municipality of La Paloma related to commercial activities on a local holiday; and, alongside Rodolfo Guillermo Vouga, act on behalf of GSI in a distribution-agreement dispute against Comtec. Clients also include Paresa, Prosegur Paraguay and Petrobras. The team welcomed associate Eusebio Lopez, who specialises in arbitration, from Latham & Watkins.

Under the leadership of Carla Sosa, Berkemeyer Attorneys & Counselors assists a broad client portfolio that includes Monsanto, Nestlé and Unilever with a wide range of contentious matters. The practice has one of the most specialised IP litigation practices in the country and is regularly instructed on commercial disputes, as well as tax, environmental and competition litigation. Most recently, Sosa successfully filed a criminal claim against a nightclub (concerning sound pollution) on behalf of hotel and casino owner Azar International; defended Dow AgroSciences in a criminal investigation related to the transportation and commercialization of agrochemical products without a license; and represented Inditex in a trade mark prosecution case against a local company regarding the trade mark ZARA.

With a strong focus on commercial litigation, Ferrere provides a ‘good level of service’ and is ‘very diligent’. A particular area of expertise is distribution agreement disputes, where co-practice head Néstor Loizaga recently reached a settlement on behalf of Cargill in a termination of contract dispute with a local distributor. The team also acted for AstraZeneca, Unilever, Petrobras and British American Tobacco. Other noteworthy practitioners are Miguel Saguier, who also co-leads the practice, and Marysol Estigarribia, who handles labour litigation.

The core area of expertise of Peroni Sosa Tellechea Burt & Narvaja’s dispute resolution team is distribution agreements, with a particular focus on the banking, mining and shipping sectors. More broadly, the practice group is experienced in arbitration and litigation proceedings and acts for an array of clients including Hidrovias del Paraguay, Sancor Seguros del Paraguay, Marubeni America and Medship Paraguay. Names to note are José Sosa Fracchia and Enrique Sosa Elizeche.

With an excellent reputation in arbitral proceedings, Altra Servicios Juridicos has carved out a strong position in the dispute resolution market. The practice group’s experience spans a variety of sectors, with particular expertise in banking-and-finance disputes. One 2017 highlight was the representation of a port facility in a multi-million claim against ADM. Founding partner José Moreno Rodríguez is the go-to figure for contentious matters at the 12-strong firm.

Commercial disputes, debt collection, tax litigation and arbitration are mainstays for the dispute resolution team at Mersan Abogados. Co-led by arbitration expert Diego Zavala and Pablo Cheng Lu, the team acts on behalf of a variety of domestic and international clients such as Banco Itaú, British American Tobacco and Bolsa de Valores. A recent case involved representing UABL Paraguay in a VAT tax dispute regarding barge-leasing. Another key instruction saw Zavala acting as arbitrator in a breach of contract damages claim between medical products distributor Jack Fack and manufacturer Comercializadora Mallinckrod Chile.
