The Moldovan economy has gained momentum with the growth rate of 3.5% forecast for 2017 bolstered by strong private consumption, recovery in remittances and a good harvest. A reform agenda to address corruption and increase transparency, coupled with further European integration, provides the platform for continuous economic stability and an increase in foreign investment. The political system remains vulnerable; however, parliamentary elections are due to take place in late 2018.

The legal market is comprised of largely local firms with a few international competitors.

Full-service firm ACI Partners Law Office has an excellent reputation for finance and transactional matters. Andrei Caciurenco and Carolina Parcalab assisted Ellation with the acquisition of software company Yopeso. On the contentious side, Daniel Martin successfully represented Impresa Pizzarotti in an infringement case brought by the Moldovan customs authority. Intellectual property is also a core strength and the team regularly handles trade mark infringement cases for a broad range of clients, including Philip Morris International and Microsoft. Igor Odobescu is also recommended.

One of the best firms in the market’, Gladei & Partners stands out for its expertise in banking and finance, regularly handling bank acquisitions, cross-border financing and debt restructuring. Managing partner Roger Gladei, who is ‘a leader in banking and finance legal advisory work’, advised Glass Container Company on a €7.5m EBRD loan. Another highlight was assisting Kaufland with multiple property acquisitions. The team includes litigator Vitalie Ciofu, ‘exceptional negotiatorViorica Bejan and the ‘strong and responsible’ Aelita Orhei.

Very good’ firm Turcan Cazac’s team is noted for its ‘business acumen’. The firm is highly rated for its banking, transactional and competition law capabilities and has specialist expertise in aircraft leasing. Octavian Cazac assisted a lender syndicate, led by Société Générale, with a pre-export finance facility to the Trans-Oil Group. In another highlight, the team advised Wizz Air on establishing an operational base in Chisinau; Alexander Turcan led the advice. Iulia Furtuna heads the litigation and employment practice and Mariana Stratan specialises in data protection.

Vernon | David’s practice covers banking and finance, M&A and dispute resolution for a wide range of high-profile clients, including Kaufland and Syngenta. Diana Neagu is advising Orange on the acquisition of cable company Sun Communications and handling the establishment of a renewable energy company for Talary. Sergiu Bivol is representing the country’s National Olympic Committee in an international arbitration against the Moldovan association of the World Taekwondo Federation pertaining to a license withdrawal.

Client-orientedEfrim Rosca & Asociatii fields ‘a strong and competent team’ that has particular expertise in litigation and handles a steady flow of transactional mandates. Highlights included successfully representing Donaris Vienna Insurance Group in a bail charge case against the Ministry of Justice. The team saw an increase in data protection work; Oleg Efrim and Ilona Panurco assisted the East Europe Foundation with data protection compliance.

Under the leadership of Tatiana Stavinschi, PricewaterhouseCoopers Legal regularly advises on corporate restructurings, transactional and tax matters. Silvia Grosu and Ludmila Ciubaciuc handled a buy-side due diligence exercise on a large Moldovan bank, which covered corporate matters, licensing and authorisations, key commercial agreements, as well as immovable assets and labour issues. Another highlight saw the group assisting Kaufland with regulatory matters related to its expansion in Moldova. Dumitru Popescu left the firm.

Schoenherr Moldova’s team, which is noted for its ‘excellent legal knowledge’ and ‘extremely fast responses’, has a strong track record handling transactional mandates. ‘Efficient and pragmatic’ managing partner Vladimir Iurkovski is assisting Swiss company Viatrans with the sale of Moldovan real estate assets and the winding-up of its local operations. Anna Cuşnir is a key name for financing and regulatory mandates; and ‘business-oriented’ Andrian Guzun is experienced in data privacy, intellectual property and competition law matters.

    The UAE federal government has recently issued a raft of important legislation, addressing and in many ways updating areas of law that are key to businesses in the jurisdiction. Amongst this legislation is Federal Decree-Law 14 of 2018 concerning the central bank and the organisation of financial institutions and activities (the New Banking Law ) and Federal Decree-Law 20 of 2018 concerning anti-money laundering and anti-terrorism financing (the New AML Law ). Both the New Banking Law and the New AML Law repeal and replace the previous legislation on their respective subjects. Importantly, the New Banking Law and the New AML Law have together enhanced the protection afforded to confidential information under UAE law, in particular where financial and legal service providers and their customers and clients are concerned. 
  • Israel Chapter in The Virtual Currency Regulation Review

    Earlier this year, the Israel Tax Authority (ITA) issued two circulars, one on the taxation of digital tokens and the second addressing the taxation of utility tokens in initial coin offerings (ICOs). Additionally, in March, the Israel Securities Authority (ISA) released a detailed interim report by the Committee for the Regulation of Public Offerings of Decentralized Cryptocurrency Coins (Report) (with a follow-up report due to come out around October 2018). Moreover, it is expected that before the end of 2018, legislation will come into force that for the first time will see Israeli primary legislation define virtual currencies as financial assets and mandate licensing for related services, as is later discussed in detail.
