Private client, trusts and tax
Bedell Cristin is, for some, ‘head and shoulders above the competition’. ‘Jersey trust law guru’ Alan Dart and Edward Bennett are recommended, and James Campbell is ‘approachable and technically competent’. Recent work for the team includes advising trustees in relation to the restructuring of trust assets.
Carey Olsen’s recent work includes drafting bespoke Jersey foundation documents and a number of Jersey discretionary trusts. Department head Paul Matthams is a key contact, and Siobhan Riley has ‘great depth of knowledge in the area of private and commercial trust structures’. Robert MacRae leads on contentious trusts matters.
Ogier has extensive expertise in advising on the establishment and administration of trusts. The team is also experienced in establishing structures using private trust companies, the restructuring of trusts, and breach of trust issues. It recently acted on the establishment of a number of foundations. Steve Meiklejohn ‘analyses issues with a depth of understanding that is difficult for peers to surpass’; and Sally Edwards is ‘an exceptional talent’.
Appleby advises high-net-worth individuals, private banks and trust companies. It also acts on the incorporation of Jersey-law foundations. Naomi Rive ‘understands the individuals and issues in her marketplace’.
At Mourant Ozannes, ‘there is always someone available to assist’. The firm plays a dominant role in relation to trust litigation, non-contentious trust drafting and Jersey foundations. Giles Corbin is ‘very knowledgeable’, and Marcus Stone has a good following among local trust companies. Mark Temple advises on trust litigation.
Collas Crill is experienced in the drafting and implementation of structures under the Foundations Law, including shari’ah-compliant versions. The team also assists with wealth planning for high-net-worth clients with assets in several jurisdictions. Richard Pirie is ‘particularly good’, and David Dorgan is also recommended.
Voisin’s Jeffrey Giovannoni advises on trusts and foundations, and has particular expertise in pensions work. Stephen Brennan advised a Jersey trust company in relation to an asset tracing claim. Ashley Hoy and Dexter Flynn are noted for contentious trust matters. Nigel Pearmain is a principal contact.
Baker & Partners does not have a non-contentious trusts department, but is instructed in contentious trusts. The team’s knowledge is ‘first rate’.
Pinel O’Shea’s Carl O’Shea (formerly of pre-merger Crill Canavan) specialises in investment funds, trusts and foundations.
Sinels is recommended for its trust law capabilities. In a recent mid-value Pauline action, the team obtained summary judgment against the Jersey resident trustee of a family trust. Matthew Godden heads the family law team.
In addition to preparing bespoke trust documentation and providing general advice to trustees and beneficiaries, Viberts Jersey Lawyers provides technical advice on establishing and using Jersey structures in estate and corporate tax planning, employee benefits and pension schemes.
