BonelliErede¬†was¬†one of the first major Italian law firms to establish an ethics and corporate compliance practice, as well as a department that specialises in white-collar criminal law. The firm also recently launched beLab, a research centre that develops working models through cutting-edge technologies. The team advises¬†Italian companies and the Italian subsidiaries of foreign groups on major Decree 231 (which deals with corporate crimes and the assessment of companies‚Äô liability)¬†investigations, and on the design, assessment and monitoring of compliance programmes. Recent work includes acting for¬†EF Solare Italia, a joint venture between Enel Green Power and F2i ‚ÄďFondi Italiani per le Infrastrutture, on risk assessment activities and the updating of its compliance Decree 231 programme.¬†Genoa-based¬†Alessandro Musella¬†leads the corporate compliance focus team and senior associate¬†Michela Maccarini¬†is project leader of beLab‚Äôs compliance management business unit.

Orrick, Herrington & Sutcliffe's 'team is really appreciated for its performance, availability and competence'. It is highly rated for compliance matters involving the Decree 231-governed corporate administrative liability of companies and financial institutions; the practice also assists with the design of compliance programmes and privacy matters following the implementation of the EU’s 2018 General Data Protection Regulation (GDPR). It recently advised several financial institutions, including AIG Europe, Allianz Group, Clessidra and Credit Agricole Assicurazioni, on Decree 231 corporate liability compliance matters. Alessandro De Nicola and Marco Dell’Antonia are the names to note.

'Responsive to the needs of clients', Paul Hastings LLP 'promotes a culture of collaboration and support, working closely with its clients, who are active participants in analysing compliance tasks'. The compliance and investigations practice advises on corporate governance and internal controls, structuring compliance programmes that are based on anti-corruption laws, international best practices and Decree 231. It also assists with white-collar crime investigations, advising Italian and overseas clients on major cross-border investigations involving the US Foreign Corrupt Practices Act, the UK Bribery Act and Italian anti-bribery laws as well as Decree 231 issues involving the criminal liability of corporations. The practice co-heads are Bruno Cova and Francesca Petronio.

Studio Professionale Associato a Baker & McKenzie's 'team has impressive know-how and global presence and gets the best results'. The compliance practice fields lawyers who are experienced in corporate criminal law, bribery and corruption, tax crime, bankruptcy, environmental law compliance, and health and safety issues. It assisted a number of companies, which belong to the Idex group, with developing their organisation, management and control models pursuant to Deccree 231. Aurelio Giovannelli and Gianfranco Di Garbo are the principal contacts. Enrico Maria Mancuso is now with Pedersoli Studio Legale.

Bird & Bird is experienced in guiding clients through investigations and prosecutions by authorities that arise from alleged compliance failings; the practice also assists with evaluating and designing compliance programmes and is particularly focused on advising on anti-money laundering (AML) and corruption and data protection compliance. The team also has sector experience in food and beverages, life sciences, infrastructure and TMT; it assisted Intesa Sanpaolo, and its group (including Banca IMI), with multiple issues arising from upcoming changes to European and Italian regulations. Raimondo Maggiore and Stefano Febbi are the key contacts.

Cleary Gottlieb Steen & Hamilton advises Italian and foreign companies on group governance issues, including those involving listed companies; the team also assists with enhancing internal control systems and the compliance functions of financial institutions and multinational groups, including updating organisational Decree 231 models. Other areas of strength include company investigations. Giuseppe Scassellati-Sforzolini and Pietro Fioruzzi are experienced practitioners; Francesco De Biasi led advice to Barilla on data protection compliance.

Led by Antonio Golino, Clifford Chance's compliance group is part of the regulatory investigations and financial crimes team in Italy. It is experienced in criminal defence and regulatory enforcement as well as the design, implementation, and execution of compliance programmes, particularly systems and controls to prevent criminal offences. Counsel Jean-Paule Castagno specialises in regulatory investigations and financial crimes.

DLA Piper's practice covers corporate compliance programmes, internal and regulatory investigations and defence in criminal matters, anti-bribery and corruption, AML issues and data protection compliance. It advised Valagro, which produces and commercialises biostimulants and specialty nutrients, on the implementation of compliance programmes. Rome-based Raffaella Quintana heads the white-collar crime, investigations and compliance practice within the litigation and regulatory department; Antonio Carino  in Milan is also a key adviser.

Hogan Lovells International LLP 'provides very accurate legal advice'. The practice's compliance track record includes internal investigations, criminal law, privacy and data protection, commercial and corporate law, and tax. Other areas of strength are product liability and compliance, media and technology, environmental law and health and safety. Fulvia Astolfi leads the compliance 231 practice and Jeffrey Greenbaum is active in compliance issues involving AML issues and the recent Payment Services Directive as well as Brexit-related compliance issues; Francesca Rolla heads the Italian investigations, white-collar and fraud department.

Chiomenti 'has unique expertise and proposes innovative solutions to complex matters'. The firm's business unit on white-collar crimes and business integrity advises on compliance programmes and corporate liability, including Decree 231 issues, AML matters, bribery and corruption, and internal investigations. In other areas the practice advised Fincantieri on the review of its internal dealing and privileged information proceedings in relation to the EU Market Abuse Regulation. Francesco D’Alessandro, who was recently promoted to the partnership, and of counsel Stefano Manacorda are the key names.

'Delivering good results', Gianni, Origoni, Grippo, Cappelli & Partners 'fields effective communicators in court, as well as the boardroom, who provide reasonable assessments of very complex matters'. Daniele Vecchi advised Costa Crociere on Data Protection Act authorisation in relation to biometric data, video surveillance processes and employee data collection. Federico Busatta is 'recommended for his calm and practical approach' and senior associate Francesca Bevilacqua's 'intelligence and judgement are outstanding'.

Legance - Avvocati Associati advises on issues involving privacy, anti-corruption legislation and Decree 231 matters as well as data protection. Andrea Fedi has extensive experience in compliance, privacy and anti-bribery and recently promoted Marco Penna's compliance experience includes AML matters and drafting procedures for the provision of banking and financial services.

CMS' practice covers defences to criminal prosecutions and investigations as well as advising Italian and foreign companies on the Decree 231 liability of companies and corporate compliance strategies. Emilio Battaglia heads the fraud and corporate criminal defence department.

Deloitte Legal ‚Äď Studio Associato's Antonella Alfonsi¬†leads the corporate compliance practice, which is 'professional, practical and focused on getting results'. Josephine Romano¬†acts for¬†international clients on corporate governance and compliance (particularly Decree 231) issues.

Nctm Studio Legale's 'team is professional, up-to-date and takes care of all details'. It is focused on anti-corruption, data protection, Decree 231 liability of corporate entities, AML matters, market abuse, health, safety and environment issues, and organisational compliance procedures. Raffaele Caldarone is the name to note.

Pavia e Ansaldo's expertise in compliance stems partly from its longstanding assistance to healthcare and pharmaceutical ccompanies. Mario Di Giulio is a Decree 231 expert and Deborah Bolco is a specialist in the application of the EU’s recent GDPR.

Pedersoli Studio Legale hired white-collar defence and investigations head  Enrico Maria Mancuso, who 'has very good technical skills and is very patient', from Studio Professionale Associato a Baker & McKenzie; his experience includes compliance matters and the conduct of internal investigations, including across multiple jurisdictions.
