Sony Corporation Entertainment Europe Limited v. Mr. Harmeet Singh & Ors. [CS(OS) No. 1725 of 2012]
Sony Corporation is the owner of Play Station devices (various versions including PS3). Sony along with its various associates are also the publishers of various gaming software programs such Drake Deception etc.
Jailbreak: Jailbreak is the process or the act of circumvention of technology protection measures (enabled within the consoles) which enables the hard disk of the PS3 console to read/play any unauthorized games on the Sony PS3 devices. The act of Jailbreak is called Jail breaking and the same is now being done at the Channel level in India at various markets in Delhi, Mumbai, Hyderabad, Bangalore etc. Few of the jail break softwares are- Multiman, Gaia Manager etc.
In the present suit, after conducting careful investigations (done at two targets) one in Delhi and one target in Mumbai. All these targets were found to be installing Jailbreak softwares onto the PS3 consoles as sold by them.
The evidence was filed in Court on the basis of which injunctions were granted by the Delhi High Court.
As per the new copyright amendment act, the act of circumvention of technology protection measures (TPMs) has a penal consequence (Section 65 A). This is the first case where the Court has referred to the latest amendment with respect to TPMs citing the recent amendment to copyright laws.
