Browne Jacobson LLP primarily advises clients from the public sector such as NHS trusts, but increasingly undertakes work for independent health providers. In addition to its impressive track record in the health sector, the team also handles social care mandates. Practice head Simon Tait recently handled a substantial number of governance-related matters, including in relation to mergers or sustainability and transformation partnerships. Oliver Pritchard advised the Derby Teaching Hospitals NHS Foundation Trust on its proposed £650m merger with Burton Hospitals NHS Foundation Trust, including full pre-merger due diligence, and governance structure and employment advice, while Tait represented the client in an investigation and subsequent inquest into the death of a two-year-old from meningitis.

Freeths LLP’s team ‘is particularly knowledgeable of the demands and challenges within the healthcare sector’ where it assists both public and private sector clients, such as NHS panels and investors. In addition, the team has strong care sector expertise ranging from the development of care homes to financing transactions, with its track record in ‘triple net’ lease security and cross-collateralised security framework agreements as a key stand-out feature. Regulatory, corporate governance and procurement instructions also form part of the caseload. A team under the lead of practice head Jon Smart advised One Housing Group on the agreement for development and leases of four luxury care homes in Buckinghamshire and Hertfordshire. Real estate specialists Thomas Golding and James Clamp ‘are particularly knowledgeable in the sector’.
