Market powerhouse and ‘top firmBDS Asesores is at the helm of labour and employment-related work and stands out for its ‘expertise, quality of service and the strength of its team’. Further noted for its ‘technical knowledge, response time and overall sound and congruent legal advice’, the practice stands out across the entire array of contentious and non-contentious work and advises employers on immigration law, collective dismissals, restructuring and regulatory matters. The sizeable team is led by the ‘excellent’ Marco Durante and fields a number of recommended lawyers, including Francisco Salas, Oscar Corrales Retana and José Joaquín Acuña; the highly-regarded Alejandro Trejos is also very active in the department. Recent highlights include advising Roche on the disassociation and termination agreement of its general manager for the Caribbean and Central American region. In other work, Durante represented Grupo Caribeños in a collective dispute filed before the Costa Rican labour ministry by the National Association of Public and Private Employees (ANEP). Other clients include Svitzer Costa Rica, Grupo Corona and Grupo Cirsa de Costa Rica.

The employment-law practice at Aguilar Castillo Love advises employers on contentious and non-contentious matters, such as compensation, benefits and day-to-day labour matters. The team is equally adept in preventative measures and labour litigation. Andrea Sáenz-Mederas and Alvaro Aguilar-Saborío are the key contacts in the department.

Led by the recommended Randall González, the labour and employment practice at BLP is highly experienced in corporate labour-law matters, such as benefits, compensation and outsourcing, as well as regulatory matters and corporate labour litigation. The firm’s department also houses an immigration law team that advises on temporary residency permits and company certification.

Benefitting from its regional network, Consortium Legal advises regional and international employers on immigration and labour law matters, such as temporary and permanent residency permits, obtaining business visas, internal investigations and administrative labour proceedings before the labour and social security authorities. The department is led by labour and security law expert Carolina Soto Monge.

Dentons Muñoz’ labour and employment practice undertakes both contentious and non-contentious work, such as immigration applications, collective dismissals, labour litigation, internal audits and day-to-day labour law advice. The team is led by Anna Karina Jiménez who recently led advice to hospitality and real estate company Pinilla regarding dismissal processes and labour litigation arising from claims brought by independent contractors, as well as claims related to allegedly unpaid overtime. In another notable highlight, the practice assisted Chiltern with the labour aspects of setting up its operations in Costa Rica, including preventive advice on the terms of hiring. Other clients include VMWare, doTerra and GlaxoSmithKline (GSK).

In November 2017, the labour and employment practice at Arias was strengthened with the rehire of senior counsel Graciela Soto from Batalla Abogados. Together with Carlos Ubico, Soto leads a practice that advises on the full spectrum of matters, including employment contracts, regulations, and labour due diligence and disputes. Notable recent work includes successfully settling a harassment and mobbing dispute for Unicomer; assisting Nature Sunshine with termination proceedings and the corporate and administrative aspects of the company closure; as well as day-to-day advice to 3M and Mondelez. The firm’s client base also includes BASF, Amvac and Sika.

With extensive experience in both contentious and non-contentious labour and employment-related work, the team at Facio & Cañas, led by Luis Sánchez, regularly receives instructions from both employers and high-profile employees (including both executives and sports people (a sub-sector where the practice is particularly active)). In notable recent work, associate Mauricio Bolaños represented Coca Cola Femsa de Costa Rica in multiple legal proceedings brought by employees with regards to allegedly unpaid overtime and, separately, the termination of labour relationships with senior managers. On the employee side, the team successfully represented several football players in employment law-related claims against their respective clubs. Other clients include Fujitsu Consulting, BT Latam Costa Rica and Enel.

Led by the ‘well-organized and knowledgeable’ Henry Lang, the department at Lang & Asociados distinguishes itself through its preventive advice on labour matters, as well as day-to-day labour issues and the employment aspects of transactions (particularly labour due diligence). In one recent highlight, the team led advice to Microsoft on the structuring of all the labour documentation and policy support for its new branch in Costa Rica. Other notable work includes assisting DeRoyal Industries with the redesign of its labour agreements, policies and contracts in light of the country’s 2017 labour law reform. Indian Industries, EX² Solutions and The Logit Group are also on the firm’s client roster.
