Cesnik, Quintino & Salinas Advogados, which celebrated its 20th anniversary in 2016, is a reference in Brazil's media and entertainment landscape, particularly in the area of audio-visual production. It acts on financing and contractual matters for large media groups such as MGM Distribution, Discovery Networks Brasil, TV Globo and TV Record, as well as production companies and investors. Gilberto Toscano led advice to Fox Brasil on production, civil and regulatory issues related to investment in local productions and co-productions, as well as on the use of tax incentives and public funds. Rodrigo Kopke Salinas provides ‘excellent legal analyses’, and founding partner Fábio de Sá Cesnik is ‘a true leader’.

‘Excellent on all counts’, Mundie e Advogados ‘works tirelessly to achieve the best results for the client’. Its recent telecoms work includes advising on pay-TV regulation, digital television, and the provision of satellite services. It is also recommended for technology matters, and is representing a client in administrative proceedings concerning net neutrality. Kevin Mundie ‘understands the nuances and complexities of the Brazilian legal system, and creatively approaches matters with a realistic and enthusiastic attitude’. He is recommended along with Ana Claudia Beppu dos Santos Oliveira, Elinor Cristófaro Cotait and associate Tomás Schoeller Paiva.

Pinheiro Neto Advogados’ ‘knowledgable, solution-oriented and pragmatic’ team stands out for its transactional capabilities, while also covering regulatory matters and dispute resolution. In 2016 it advised video- and music-on-demand streaming service Watchever on structuring its business in Brazil, and on authorising a live concert stream. Another highlight was assisting Abril Radiodifusão in the sale of its bradcasting licence to Grupo Spring. Recommended individuals include Raphael de Cunto, André Zonaro Giacchetta and José Mauro Machado, who ‘brings rationale and reason into Brazil’s complex legal framework’. Esther Nunes has retired.

Azevedo Sette Advogados’ ‘technically adept’ media and entertainment group advises on technology licence agreements, mobile payment systems and data protection matters. On the contentious side, highlights included defending Electronic Arts in litigation brought by 150 plaintiffs concering its FIFA video game. Other clients include Netflix, Spotify and Twitter. Luiz Sette, Ricardo Barretto Ferreira da Silva and IT expert Paulo Brancher are recommended.

Media expert Marcos Alberto Sant’Anna Bitelli at Bitelli Advogados has ‘a deep understanding of the sector’s legal landscape, and excellent relationships with key players’. The group’s ‘quick and thorough advice’ covers both media and entertainment, and IT matters.

Manesco, Ramires, Perez, Azevedo Marques Sociedade de Advogados’ ‘accurate and service-oriented’ team regularly acts on the implementation and maintenance of telecoms infrastructure and related regulatory matters. Clients include numerous large telecoms operators. The ‘outstanding’ Eduardo Augusto de Oliveira Ramires and Floriano de Azevedo Marques Neto are recommended.

Media and entertainment boutique Schivartche Advogados regularly advises clients such as Sony Pictures, Paramount and Warner on investment in and the distribution of feature films produced in Brazil. André Schivartche leads a team of ‘accomplished lawyers’.

Veirano Advogados saw an increase in demand for data privacy advice. Media and technology expert Fábio Pereira assisted Dell in the development of software, and advised Mastercard on the potential use of taxpayer registration numbers when accessing digital wallet accounts. Valdir Rocha and Robson Barreto are the names to note for telecoms matters.

Inglez, Werneck, Ramos, Cury e Françolin Advogados (IWRCF) represented advertising agency AlmapBBDO in several administrative proceedings concerning campaigns, and also acted for Nissan, Nivea and Volkswagen in advertising-related matters. Founding partner Luiz Werneck leads the marketing and advertising team.

A highlight for KLA-Koury Lopes Advogados was assisting Rádio e Televisão Bandeirantes in the drafting and negotiation of content licence agreements, led by media specialist Tania Liberman. Karin Alvo is the name to note for technology advice, and Guilherme Ieno is recommended for telecoms matters.

Levy & Salomão is highly recommended for both regulatory advice and disputes in the TMT sector. Media, entertainment and sports expert Simone Lahorgue Nunes led advice to Netflix on licensing agreements and contractual structures for productions in Brazil. Alexandre Ditzel Faraco is the name to note for telecoms and technology.

Ivandro Maciel Sanchez Júnior heads the media and entertainment practice at Machado Meyer Sendacz e Opice Advogados, and is experienced in sports law. He led advice to Clube Atlético Paranaense on the international transfer of athletes. Other clients include FremantleMedia, HBO, Sony Entertainment Television, and Verifone and Vivo on the telecoms side.

Mattos Filho, Veiga Filho, Marrey Jr. e Quiroga Advogados is particularly known for its work on regulatory matters in the telecoms sector, while its technology practice is also gaining in profile. A recent highlight was representing WhatsApp in litigation and investigations concerning the transfer of users’ data to Facebook and the company’s end-to-end encryption technology. ‘Very attentive’ telecoms and technology expert Fabio Ferreira Kujawski leads the group.

Ronaldo Lemos and Caio Mario da Silva Pereira Neto co-head Pereira Neto | Macedo’s TMT department, which stands out for its telecoms expertise. The group is appointed as chief regulatory adviser in relation to the restructuring of Oi’s debt, and assisted TIM Brasil in analysing zero-rating offers.

Rolim, Viotti & Leite Campos Advogados regularly advises on Anatel’s radiofrequency bids, and counts Claro, Telefónica and Oi among its other clients. On the contentious side, it is representing SindiTelebrasil in litigation concerning a telecoms operator’s liability for service interruptions. Rodrigo Azevedo Greco has ‘deep and long experience in the sector, and always brings critical input’.

Trench Rossi Wanatabe regularly acts on IT, e-commerce and outsourcing matters. On the media and entertainment side, it advised Universal Pictures on dubbing and promotion services. Esther Miriam Flesch and Flávia Rebello are the names to note.

Particularly recommended for telecoms matters, BMA – Barbosa, Müssnich, Aragão represented Centennial Torres in administrative proceedings held by ANATEL concerning a conflict with Nextel over the use of radio access network sharing towers. ‘Smart’ regulatory expert Eduardo Hayden Carvalhaes Neto is ‘very pleasant to work with’.

IP boutique Dannemann Siemsen Advogados’ Attilio José Ventura Gorini is highly rated for his work for media and entertainment clients.

Corporate partner Evy Marques leads the team at Felsberg Advogados, which regularly advises clients in the TMT sector on technology transfer and software licence agreements. It also has expertise in sports and entertainment matters, including athletes’ image rights.

Led by the ‘experienced’ Maurício Vedovato, Lilla, Huck, Otranto, Camargo Advogados provides ‘accurate and comprehensive’ support to clients such as Maurício de Sousa Produções, Bromélia Produções and Rádio SP Um. It expanded its sports law practice with the addition of Luiz Otávio Rodrigues Ferreira from MMFF | Advogados e Consultores.

Siqueira Castro – Advogados advised Nextel and Telefónica on the licensing and construction of cell sites, and is defending Panasonic in various consumer lawsuits. Alfredo Ferrari is the name to note.

The ‘knowledgeable’ Marcela Waksman Ejnisman leads TozziniFreire Advogados’ TMT group, following Fernando Cinci Avelino Silva’s departure for an in-house position. The team has strong corporate expertise, and recently advised BMW on regulatory matters relating to the provision of ConnectedDrive services.

Frederico Buosi leads Vella Pugliese Buosi e Guidoni Advogados’ ‘hard-working’ team, which delivers ‘solutions to accomplish business goals’. It specialises in advising technology start-ups as well as telecoms and IT providers.
