The standalone, full-service tax practice at Lefosse Advogados excels in tax consulting, transactional tax and litigation. Among its differentiating qualities are the strong accounting and finance background of many of its lawyers, and the level of cooperation between individual team members, who have an emphasis on litigation or consulting and collaborate closely with one another. The practice focuses on high-end work, where it is instructed by major players in the Brazilian market as well as large multinationals. Among a long list of standout transactions, the firm acted for Singapore sovereign wealth fund GIC on its acquisition of a 40% stake in Cruzeiro do Sul Educacional, with Celso Costa leading on the tax aspects. Its full-service offering includes tax litigation at administrative and judicial levels, transactional tax and non-transactional tax consulting, and it is notable for its substantial expertise in private wealth. On the transactional side, the team had another busy year. Highlights included advising Cosan on the sale of a corporate interest in two companies to Mansilla Participações, a company controlled by Teachers Insurance and Annuity Association of America, with Flávio Mifano acting as part of a multidisciplinary team. Alessandro Amadeu da Fonseca advises companies and high-net-worth individuals on Brazilian tax law and international treaties. Renata Correia Cubas’ broad tax practice takes in VAT and customs matters, while key tax litigators include João Marcos Colussi, Alessandra Gomensoro, Glaucia Maria Lauletta Frascino and Paulo Camargo Tedesco. Luiz Felipe Centeno Ferraz and Marcel Alcades Theodoro are other leading figures in the department.

Under the leadership of highly regarded department head Sérgio Farina Filho, Pinheiro Neto Advogados has a buoyant and busy tax practice which covers the gamut of taxation matters in Brazil. Trench Rossi Watanabe is recommended for high-end, complex tax matters and is noted for its ‘sound, practical advice’ and ‘technical mastery’. It had another busy year both in tax litigation and transactional tax matters. Thanks to its international expertise, the team has also attracted a number of instructions following the US tax reform in 2017. Global tax leader Simone Dias Musa is ‘outstanding for planning large transactions with multinational consequences’. ‘Great communicator’ Ana Carolina Utimati, Paulo Rogério Sehn, Maria Fernanda Furtado and Leonardo Alfradique Martins are also recommended. Tax is a core practice area at Ulhôa Canto, Rezende e Guerra Advogados, which fields a large team of professionals with expertise across the full spectrum of taxation matters in Brazil. It is particularly active in the energy, sports, retail and financial services sectors, and counts FIFA, Banco Credit Suisse (Brasil) and Aliansce Shopping Centers among its clients. A multidisciplinary team including tax partner Rodrigo Brunelli Machado advised the latter on the sale of an interest in Caxias Shopping Center to XP Malls. The firm also has a busy tax litigation department, which has achieved a number of recent successes for clients. Recent cross-border work includes acting for South Korea’s CJ CheilJedang on the acquisition of a 90% stake in Sementes Selecta from Chilean group Corpesca, with Carlos Eduardo Orsolon leading on the tax aspects. Christiano Chagas Monteiro de Melo advises private equity firms and financial institutions on international taxation and the structuring of investment funds; Marcelo Salles Annunziata heads the tax litigation department; and Rodrigo Ramos de Arruda Campos leads the social security tax practice. Other important partners are Pedro Miguel Ferreira Custódio, Eloisa de Almeida Rego Barros Curi and the ‘very experienced’ and ‘accurateDouglas Mota.

Boutique firm Dias De Souza Advogados Associados, in São Paulo, enjoys a strong reputation in the market and is particularly active in tax litigation, where it has an impressive track record. Clients include household-name multinationals and domestic companies from a range of industries. Founding partner Hamilton Dias de Souza has a diverse practice covering tax, administrative law and public law matters. Mário Luiz Oliveira da Costa is another key contact.

Machado Associados advises on the gamut of taxation and provides a ‘tailor-made service’ to its clients. It is well known for its experience in the cosmetics sector, in which it has a number of high-profile clients, though its client base extends beyond that industry. It is well versed in cross-border matters, often working with leading international law firms. The ‘very open and direct’ Ricardo Marletti Debatin da Silveira ‘always seeks the best result’, and Paulo Rogério Garcia Ribeiro is also recommended. Founding partner José Maurício Machado has over 40 years of experience in tax and corporate law. Luís Rogério Farinelli specialises in direct tax, and Erika Yumi Tukiama in international tax.

Tax firm Mariz De Oliveira e Siqueira Campos Advogados is well established in the market and assists a large roster of longstanding clients. Tax litigation is a key strength, covering the full range of proceedings at municipal, state and federal level. Among its best-known practitioners are Ricardo Mariz de Oliveira and Roberto De Siqueira Campos, and Bruno Fajersztajn and Sandra Mara Rossetti De Paula are key names in the field of direct tax.

Veirano Advogados attracts praise for its ‘deep knowledge’ in taxation. Its team is split between the firm’s offices in São Paulo, Rio de Janeiro, Brasília and Porto Alegre. Practice head Marcelo Reinecken and highly recommended partner Marco Monteiro acted for Microsoft Mobile in a lawsuit to suspend and annul a confiscation penalty regarding past imports; after challenging the case at the administrative level, the team was retained to represent the client in judicial proceedings and successfully obtained an injunction to suspend the penalty. In recent work, Daniel Abraham Loria advised Abengoa Concessões Brasil Holding on tax issues involved in its court-supervised debt restructuring. Tax litigator Lígia Regini da Silveira is highly recommended, and Maurício Pereira Faro and Luiza Sampaio de Lacerda Benjó are also key contacts on the contentious side. Tax boutique BRATAX – Brazuna Ruschmann e Soriano Sociedade de Advogados is noted for its ‘very good service’ and is highly sought for its tax litigation expertise. Prior to the firm’s establishment in 2013, many of its lawyers gained valuable experience in leading firms in Brazil. Its clients include leading players in numerous sectors of the economy; particular specialisms include the technology, pharmaceutical and chemical industries. Bichara Advogadosworks in close partnership’ with its clients, and provides ‘a high-quality service’. 2017 saw the team act in a range of complex tax litigation at the administrative and judicial level, and it was also active on the advisory side, in relation to tax planning, compliance, M&A deals and corporate restructurings. Cescon, Barrieu, Flesch & Barreto Advogados counts several household-name companies among its longstanding clients. The team is well versed in sensitive tax litigation, and regularly advises on the tax aspects of corporate transactions. In tax consulting, the group has extensive knowledge of direct and indirect tax. In one highlight, Sarah Mila Barbassa advised Kellogg on the acquisition of a stake in Parati. In litigation, Hugo Leal achieved a favourable second instance decision for EDP Brasil concerning goodwill-related deductions generated by the acquisition of shares in a special purpose company. Key partners include Roberto Duque Estrada and Renata Emery.

Transfer pricing is a specialism at Castro, Barros, Sobral, Gomes Advogados, which has a broad contentious and non-contentious tax practice. The team advises clients operating in a range of sectors, and is particularly active in the retail and telecoms industries. André Gomes de Oliveira heads the department, which includes litigators Daniela Alves Portugal Duque Estrada and Leandro Bertolo Canarim.

Dias Carneiro Advogados is noted for its ‘high-level service’ and ‘very good English language skills’. The ‘very committed’ Antonio Amendola co-heads the practice with Rodrigo Maito da Silveira. The team’s work spans tax and customs disputes, advice on tax incentives and special customs regimes, and assistance in domestic and cross-border transactions.

The five-partner tax practice at Lobo de Rizzo Advogados has seen growth in recent years, and is notable for its work on transactional tax and transfer pricing matters, as well as handling a range of tax consulting and litigation. Alexandre Siciliano Borges and Mariana Miranda Lima are recommended together with recently promoted senior associate Maria Carolina Bachur.

The ‘attentive, efficient and practical’ tax team at Rothmann Sperling Padovan Duarte Advogados has ‘deep knowledge of different types of businesses’. The ‘smart and easy-going’ Paulo César Teixeira Duarte Filho ‘explains complex issues easily’, and ‘provides an in-depth analysis’. Gerd Rothmann is an expert in international taxation. Fábio Piovesan Bozza joined from Mariz De Oliveira e Siqueira Campos Advogados. Marcio Sperling and associate Arthur Pereira Muniz Barreto are also recommended. Exceptional’ tax firm Sacha Calmon e Misabel Derzi Consultores e Advogados is highlighted for its ‘huge expertise’ and ‘business-oriented approach’. Active in tax litigation and consultancy matters, Siqueira Castro – Advogados stands out for having tax lawyers in numerous offices across Brazil; Bianca Xavier in Rio de Janeiro, Maucir Fregonesi Junior in São Paulo and Salvador-based Marluzi Andrea Costa Barros co-head the practice. Its client base is a mixture of domestic and international companies active in various sectors, including food, financial services and logistics.

TozziniFreire Advogados’ tax team advises on high-value M&A, international trade, and international tax matters, and handles tax litigation in venues across the country. It also has impressive industry-specific tax knowledge spanning the telecoms, IT and energy industries, among others. The team’s diverse client base includes major international companies, high-net-worth individuals and start-ups. Vinicius Jucá Alves acted for the Brazilian Association of Agribusiness (ABAG) as amicus curiae in two cases before the Supreme Court concerning the constitutionality of certain tax penalties. Jerry Levers de Abreu is recommended. Ana Cláudia Akie Utumi and Camila Abrunhosa Tapias left for Utumi Advogados, though Utumi continues to act as a consultant to the firm.

Leite, Tosto e Barros Advogados Associados has a good track record in tax litigation. The team is currently representing two investors in a challenge to two tax assessments seeking payment of $10m, with Cibele Toldo and Carlos Henrique Crosara Delgado leading the advice.

    Earlier this year, the Israel Tax Authority (ITA) issued two circulars, one on the taxation of digital tokens and the second addressing the taxation of utility tokens in initial coin offerings (ICOs). Additionally, in March, the Israel Securities Authority (ISA) released a detailed interim report by the Committee for the Regulation of Public Offerings of Decentralized Cryptocurrency Coins (Report) (with a follow-up report due to come out around October 2018). Moreover, it is expected that before the end of 2018, legislation will come into force that for the first time will see Israeli primary legislation define virtual currencies as financial assets and mandate licensing for related services, as is later discussed in detail.
