Machado Meyer Sendacz e Opice Advogados’ labour group recently assisted Virbac in negotiations concerning the termination of employment of its CEO and the hire of a replacement; and acted for Votorantim Energia in collective negotiations with several labour unions aiming at reducing payroll costs. Other areas covered by the group include immigration, class actions and mass dismissals. Rodrigo Seizo Takano and Sólon de Almeida Cunha are the two partners in the team. Senior associate and ‘excellent negotiator’ Carolina Tavares Rodrigues gives ‘robust and practical advice’. Since publication, de Almeida Cunha and Tavares Rodrigues have left the firm.

Labour law boutique Mallet Advogados Associados has a seven-partner team including some of the market’s most renowned individuals, with Estêvão Mallet and Olinda Maria Moreira Alves de Oliveira Mallet leading the way. The firm handles strategic litigation as well as the full gamut of consultancy services.

The ‘very strategic’ team at TozziniFreire Advogados covers employment claims, corporate governance structures, mass terminations, strikes and negotiations with unions. It is regularly instructed by large national and international companies, including BMW, Colgate-Palmolive, GE Brasil, Grupo Pão de Açúcar, and MasterCard Brazil. Marcelo Pereira Gômara and Mihoko Sirley Kimura are recommended.

Veirano Advogados’ practice includes investigations of labour law compliance, collective dismissals and contract negotiations. It recently defended CEVA Logistics against a class action filed by a Minas Gerais union and against two individual complaints by former executives. Another strength is transactional support, such as assisting Microsoft on the labour law implications of the sale of its Manaus plant to Flextronics. Luiz Guilherme Migliora and José Carlos Wahle are recommended along with Luiz Antonio dos Santos Jr., who has ‘excellent technical understanding’.

Within the ‘assertive’ six-partner team at Demarest Advogados, Cássia Pizzotti, who displays ‘great interpersonal skills’, and Renato Canizares are the key names for advisory matters. On the contentious side, the group defended Electrolux against collective labour claims filed by former employees of another company, which maintained a relationship with the client before going bankrupt. Paulo Valed Perry Filho is now with Siqueira Castro Advogados.

Labour law boutique Granadeiro Guimarães Advogados covers compliance, risk assessment and contractual advice, undertakes negotiations with unions, and represents clients in administrative proceedings and litigation. Gustavo Granadeiro Guimarães is the key figure in the 30-lawyer team.

Lilla, Huck, Otranto, Camargo Advogados regularly acts in labour litigation over employment status, collective bargaining agreements and accidents at work. Maria Fernanda de Medeiros Redi and Célia Mara Peres have significant expertise in the area.

Mattos Filho, Veiga Filho, Marrey Jr. e Quiroga Advogados’ impressive client roster includes Carrefour, Embraer, Fiat Chrysler Automobiles, and JP Morgan. Vilma Toshie Kutomi and Domingos Antonio Fortunato Netto advise on strategic labour claims and the full range of non-contentious matters, and were joined by Dario Abrahão Rabay, formerly at Souza, Cescon, Barrieu & Flesch Advogados, in February 2016.

Pinheiro Neto Advogados regularly handles big-ticket matters. It recently filed an appeal before the supreme federal court on behalf of John Deere against a decision made in a class action brought by a labour union and concerning hazard and danger pay; it successfully negotiated a settlement. Luís Antônio Ferraz Mendes leads the team.

Robortella Advogados is a boutique covering the full range of advisory matters and litigation. Luiz Carlos Amorim Robortella is highly rated.

Trench, Rossi e Watanabe Advogados, associated with Baker & McKenzie’s lawyers are noted as building ‘strong and consistent relationships’. Among its recent highlights, the team represented Eaton in a claim filed by a union concerning the recognition of validity of a profit-sharing plan. Letícia Ribeiro Figueiredo has ‘deep legal knowledge’. Tricia Maria Sá de Oliveira made partner in 2015.

BMA – Barbosa, Müssnich, Aragão recently acted for French group PMU on entering into an agreement with Jockey Club do Brasil for the joint execution of betting activity, including preparing employment agreements and advising on benefits matters. Cibelle Goldfarb and Luiz Felipe Tenório da Veiga took over joint leadership of the team following the departure of Maurício Pessoa to found boutique firm Pessoa & Pessoa Advogados Associados S/C, but as we go to press Tenório da Veiga has announced his departure to establish Tenório da Veiga Advogados, taking associate Denise Valente with him.

KLA – Koury Lopes AdvogadosAlexandre Pessoa and Ana Cristina Valentim have recently advised numerous clients on terminations, and have also been active in disputes concerning employment status.

The ‘responsive, precise and knowledgeable’ team at L.O. Baptista, Schmidt, Valois, Miranda, Ferreira, Agel recently drafted profit-sharing plans for a large Brazilian company. Practice head Fábio Chong de Lima acts for numerous foreign clients, and has ‘a truly international view’.

The team at Lobo & de Rizzo Advogados advises pharma companies such as AstraZeneca, Glenmark and Shire Farmacêutica, and also acts for numerous banks. Andréa Giamondo Massei Rossi heads the practice.

The ‘proactive and reliable’ group at Machado Associados is led by the ‘dedicated and professionalFabio Medeiros. It is best known for its tax expertise, and regularly assists foreign law firms in relation to local labour regulations.

Mascaro e Nascimento Advogados handles both contentious and non-contentious matters for an impressive roster of domestic and international clients. Marcelo Costa Mascaro Nascimento is a key name.

Cássio Mesquita Barros at specialist labour law firm Mesquita Barros Advogados is recommended by clients and peers alike, particularly for dispute resolution.

Labour boutique Pipek Penteado e Paes Manso Advogados has a wide-ranging contentious and non-contentious practice, with Arnaldo Pipek particularly recommended.

At Siqueira Castro Advogados, the ‘experiencedCarlos Eduardo Vianna Cardoso and ‘precise’ Otavio Pinto e Silva co-lead the team. Fabiana Galdino Cotias was promoted to the partnership in October 2015, while Paulo Valed Perry Filho joined in January 2016.

Souza, Cescon, Barrieu & Flesch Advogados has been active in relation to internal investigations, collective dismissals, and class actions, ‘quickly assembling a multi-disciplinary team if necessary’. Recently appointed partner Aldo Augusto Martinez Neto took over as practice head following Dario Abrahão Rabay’s departure to Mattos Filho, Veiga Filho, Marrey Jr. e Quiroga Advogados in February 2016.

Tauil & Chequer Advogados in association with Mayer Brown’s labour and employment team, led by Maurício Tanabe, has been active representing companies in litigation brought by former employees following the termination of work contracts. Since the conclusion of research, Maurício Tanabe has moved to Campos Mello Advogados.

Advocacia Fernando Rudge Leite is highly rated for its work in the manufacturing, construction, mining and transportation sectors, and regularly advises on asbestos-related matters and safe working conditions. The four-strong team is led by Sueny Andrea Oda.

Advocacia Maciel, under the lead of founding partner José Alberto Couto Maciel, regularly assists companies in the handling of accidents at work and work-related illness.

The ‘risk-aware and business-focused’ team at Almeida Advogados represented TecTotal in filing an action relating to a fine imposed by the Ministry of Labour for having entered into an allegedly illegal agreement with a co-operative. Other clients include Dafiti, Indra Sistemas, Prosegur and Stericycle Brasil. Adriano Claudio Pires Ribeiro leads the team since Luiz Fernando Alouche's departure to Inglez, Werneck, Ramos, Cury e Françolin Advogados.

Ana Lúcia Pinke Ribeiro de Paiva leads the three-lawyer group at Araújo e Policastro Advogados, which has been acting in relation to mass lay-offs and the termination of employment of high-level executives, union negotiations and class actions. Its client roster includes Alcoa Alumínio, Conference Call do Brasil, Keysight Technologies and Tricon Energy.

Azevedo Sette Advogados has an ‘attentive’ team, with the ‘business-minded and responsive’ Mariá Guitti and Gustavo Magalhães Assis recommended. The firm acts for Claro, Holcim and Votorantim, and is representing Volkswagen in litigation.

Bichara Advogados is best known for its litigation expertise, with practice head João Pedro Eyler Póvoa recommended.

Cascione, Pulino, Boulos & Santos Advogados’ Eduardo Juaçaba is regularly instructed regarding the hiring and dismissal of high-level executives, and has a strong niche advising start-ups.

Castro, Barros, Sobral, Gomes Advogados, led by Flávia Filhorini Lepique, covers litigation and transactional support, and has also been active assisting with investigations into employee conduct, the recognition of employment status and the formulation of labour policies, particularly non-competition clauses.

DDSA – De Luca, Derenusson, Schuttoff e Azevedo Advogados represented shipping group CMA CGM in a labour claim concerning an alleged occupational accident. Leila Pigozzi Alves is the name to note.

De Vivo, Whitaker e Castro Advogados has a strong profile for contentious matters, and BMW do Brasil is a client on the non-contentious side. Andrea Pulici and Walter Abrahão Nimir Junior are the names to note. Since research closed, Walter Nimir has moved to Zeigler e Mendonça de Barros Sociedade de Advogados.

Under the lead of André de Melo Ribeiro, Dias Carneiro, Arystóbulo, Flores, Sanches e Thomaz Bastos Advogados is experienced in advising distressed companies, and recently assisted Schahin Engenharia in laying off 2,500 employees.

Lefosse Advogados acts for numerous foreign firms as well as having a strong national client roster. Practice head Aloizio Ribeiro Lima advised Commerz Brasil on drafting its remuneration policy for statutory directors.

Luciana Arduin Fonseca leads Leite, Tosto e Barros Advogados Associados’ team, which acts for numerous banks and energy and infrastructure clients. Former co-practice heads Marcus Vinicius Mingrone and Arthur Cahen left to found Cahen & Mingrone Advogados.

Levy & Salomão counts Camargo Corrêa, Shanghai MicroPort Medical and Sumitomo among its clients, recently advising the latter on visa regulation for Japanese employees. Senior associate Silvia Fidalgo Lira and dispute resolution head Angela Di Franco are the names to note.

    With the start of operation in certain BOT and other PPP model infrastructure projects in Turkey, refinancing alternatives have become more attractive and diversified.     In a decision issued on March 8, 2017, the Philippine Court of Appeals (CA) denied the petition by NGO Ang Aroroy ay Alagaan, Inc. and certain individuals, for the issuance of a writ of kalikasan against Filminera Resources Corporation, and its directors and officers. The petitioners have claimed that Filminera, which operates in the Philippine province of Masbate, had been causing environmental damage in the conduct of its mining operations in violation of local law, and that a writ of kalikasan should be issued.
