The ‘knowledgeable’ team at Demarest Advogados provides a ‘swift and high-quality’ service, advising on matters such as site contamination and the implementation of reverse logistics systems for polluting industries. In the latter area, a highlight was advising a coalition of five major industry associations on the settlement of a sectoral agreement with the federal government concerning packaging. Mattos Filho, Veiga Filho, Marrey Jr. e Quiroga Advogados stands out for its specialism in brownfield sites and site contamination, and is also active in the areas of waste take-back, environmental licensing and litigation. A team led by Luiz Gustavo Bezerra is representing Vale in a notable civil action brought by the Ministério Público Federal concerning the bioinvasion of the sun coral species on the coast of Rio Grande do Sul. Lina Pimentel Garcia has ‘ample technical and practical knowledge’, and recently acted in a unique, culturally sensitive compensation claim concerning the spiritual damage caused to an indigenous community by a plane crash in the Amazon rainforest.

With over 15 years of experience behind it, the environmental group at TozziniFreire Advogados is well versed in the areas of environmental licensing, contaminated sites and pre-acquisition due diligence, as well as assisting developers and investors with climate change and carbon market issues. Bianca Signorini Antacli, who has ‘excellent regulatory knowledge’, is acting for União Química on the potential acquisition of a manufacturing plant owned by Zoetis, including advising on the negotiation of a long-term manufacturing agreement. ‘Practical, objective’ practice head Adriana Mathias Baptista is ‘outstanding’.

Tauil & Chequer Advogados in association with Mayer Brown has recently been active in issues related to Free Prior and Informed Consent (FPIC) for the exploitation of natural resources. The group is also representing Estaleiro BrasFELS in a public civil action filed by the public prosecutor’s office concerning the biological invasion of sun coral in the bay of Ilha Grande. The team at Bichara Advogados, led by Luciana Gil Ferreira, has particular expertise in infrastructure-related environmental matters such as energy, telecoms, and water and waste management projects. Specialising in environmental preventative consultancy and litigation, Rolim, Viotti & Leite Campos Advogados continues to advise Kinross and Vale on environmental licensing matters and conflict mediation related to mining projects. In other areas, it is assisting Femsa with the licensing, permitting and negotiation concerning the installation and operation of a new industrial plant in the state of Minas Gerais. Thiago Pastor heads the six-strong team.

It is defending Saneamento e Energia Renovável do Brasil in three public civil actions filed by the public prosecutor’s office, and assisted Açúcar Guarani in obtaining an operating licence for an industrial unit.     The UAE federal government has recently issued a raft of important legislation, addressing and in many ways updating areas of law that are key to businesses in the jurisdiction. Amongst this legislation is Federal Decree-Law 14 of 2018 concerning the central bank and the organisation of financial institutions and activities (the New Banking Law ) and Federal Decree-Law 20 of 2018 concerning anti-money laundering and anti-terrorism financing (the New AML Law ). Both the New Banking Law and the New AML Law repeal and replace the previous legislation on their respective subjects. Importantly, the New Banking Law and the New AML Law have together enhanced the protection afforded to confidential information under UAE law, in particular where financial and legal service providers and their customers and clients are concerned. 
  • Israel Chapter in The Virtual Currency Regulation Review

    Earlier this year, the Israel Tax Authority (ITA) issued two circulars, one on the taxation of digital tokens and the second addressing the taxation of utility tokens in initial coin offerings (ICOs). Additionally, in March, the Israel Securities Authority (ISA) released a detailed interim report by the Committee for the Regulation of Public Offerings of Decentralized Cryptocurrency Coins (Report) (with a follow-up report due to come out around October 2018). Moreover, it is expected that before the end of 2018, legislation will come into force that for the first time will see Israeli primary legislation define virtual currencies as financial assets and mandate licensing for related services, as is later discussed in detail.
