Arzinger & Partners has a standout real estate financing practice. Recent highlights include assisting Unibep with the construction of a Minsk hotel and advising SB Invest on a shopping centre development in Mozyr. The team is headed by ‘real estate specialist’ Dmitry Viltovsky, who is able ‘to identify and satisfy the needs of each client’ and has strength in ‘strategic planning’.

At Revera, practice head Denis Bogdanov provides ‘cleverly manages construction projects’ and associate Anna Aniskevich is a ‘very active and self-confident lawyer, who ‘understands companies’ needs. The team assisted Ericsson Nikola Tesla with an $11m long-term evolution network construction project.

Borovtsov & Salei has traditionally been active in top-end real estate and construction projects. Practice head Vassili Salei is advising Franck Muller Watchland on the construction of production facilities in its Minsk watch plant and advised RRY Capital on legal issues related to the development of a Minsk shopping mall. Senior associate Nikolay Artemyev re-joined the firm in 2017 from an in-house position with Belgazprombank.

Egorov Puginsky Afanasiev & Partners’ team provides ‘an excellent service and has sound legal and commercial judgement’ Dennis Turovets recently advised RUE Vitebskenergo on the financing of the Vitebsk hydropower plant and assisted EBRD with investment projects. Other key figures are ‘cool-headed, personable and pragmatic’ Anton Novitski and ‘straightforward and honest’ Igor Yatskovsky.

Kiryl Apanasevich leads Sorainen’s real estate and construction practice. Recent highlights include acting for the Swedish embassy on lease negotiations pertaining to its premises in Minsk’s historical centre and advising the IFC on the extension of a $10m loan to A-100 to refinance construction of commercial real estate. Senior associates Aliaksei Daryin and Maria Rodich are other key figures.

Sysouev, Bondar, Khrapoutski’s real estate and construction practice is led by Ivan Martynov and Alexander Bondar. The team advised Slavkaliy on the development of a potash mining project valued at over $1.6bn, and handled all legal aspects pertaining to the development and operation of Marriott Hotels & Resort’s first hotel in Minsk.

VMP Vlasova Mikhel & Partners’s team, headed by Ekaterina Zabello, has handled a number of projects in the tourism, retail and energy sectors. Highlights included acting for Kopaonik Investment Property on the construction of a multi-use complex in Minsk and assisting Vistar Engineering with the construction of a biogas production facility. The team also worked with a charitable fund on a project to reconstruct and beautify cemeteries.

At Verkhovodko & Partners LLC, the team provides ‘incredible support in construction and commercial real estate’. Managing partner Dmitry Bokhan has the confidence ‘to take the lead in any negotiations’; Nina Knyazeva ‘has an ability to handle difficult work in a very constructive and positive way’; and Ksenia Zhukovskaya ‘is proactive and quickly adapts her strategy to better protect clients’ interests. Highlights included implementing an investment project for MMPZ-group and advising on the construction of residential properties for Green Bay.

Cobalt advised a number of international clients on real estate projects in Belarus. The team advised Swoods Export on the acquisition of additional premises for a wood-processing complex in the Minsk region and assisted Viciunai Group with its purchase of a food warehouse, liaising with state authorities on both projects. Managing partner Darya Zhuk is the key name.

Stepanovski, Papakul and partners’ team has been involved in a number of significant construction projects and has a growing insolvency and distressed real estate practice. Andrei Vashkevich leads the team.

US Invest LLC is best known for supporting Chinese companies acting as general contractor in large construction projects in Belarus, recently providing legal support to China CAMC Engineering on the construction of a sulphated bleach pulp production plant. Managing partner Dmitry Deriugin leads the team.

Vilgerts’ head of energy practice Eugenia Urodnich has expertise in investments with a focus on greenfield renewable energy projects.   • Formation of the Customs Union of Russia, Belarus and Kazakhstan

    Russia, Belarus, and Kazakhstan will adopt new unified customs tariff and non-tariff regulations from January 1, 2010, and the Customs Union (the “CU”) of the three countries of the Eurasian Economic Community (the “EurAsEC”) will become a reality. The CU Customs Code (the “Customs Code”) is expected to take effect from July 1, 2010 to regulate the resulting integral customs zone.
  • Belarus Amends its Investment Legislation

    On 6 August 2009, the President of the Republic of Belarus signed Decree No. 10 On the Creation of Additional Conditions for Investing in Belarus. An investment contract is one of the ways of investing in the Republic of Belarus and enables an investor to obtain State support for an investment project and a waiver of sovereign immunity from suits, cautionary judgments, and enforcement of judgments and/or arbitration awards. Decree No. 10 introduces a new procedure for entering into investment contracts. It allows investors to be granted preferences and privileges under investment contracts, in addition to those granted under existing legislation, and also regulates the privileges to be granted to investors automatically upon execution of investment contracts.
  • Belarus Trademark Law Amended

    On July 15, 2009 Belarus passed the Law on the Introduction of Amendments to the Law of Republic of Belarus on Trademarks and Service Marks, which comes into force on January 25, 2010. The rationale behind the amendments is to bring Belarusian law in line with European countries’ laws - to facilitate eventual accession of the country to the WTO, and also to reflect new developments in case law.
