Arzinger & Partners' team has 'a deep knowledge of the law’, ‘high commitment to clients’ and acts ‘in a timely manner with proper care to details’. Dmitry Viltovsky heads the practice and handles transactions, land plot allocations and mortgage issues and is also noted for his ‘deep practical knowledge of construction projects’. Recent highlights include acting for Poland-based Unibep on the construction of a logistics centre in Orsha spanning 230ha and advising the Ministry of Natural Resources and Environment of the Republic of Belarus on the construction of a windmill complex. Associate Maria Golovko is also noted for her expertise in the construction space.

REVERA is currently acting for the Belarus National Biotechnological Corporation on the construction of a complex of lysine, threonine and tryptophan plants as part of a $1bn hi-tech agricultural project. Practice head Denis Bogdanov led on the matter and also recently advised Komkon on the construction of a centre in Minsk spanning 17,000 square meters. Bogdanov has further experience in handling the purchase, operation and sale of real estate. Other noteworthy clients include Industrial Park Development Company, the Embassy of the Czech Republic and Deilmann-Haniel. Associate Anna Aniskevich leads the construction sub-practice.

Ivan Martynov heads the practice at SBH Law Office, which has expertise in negotiations with government bodies, project implementation, complex transactions and litigation. The team recently acted for VKMS Berkut on a joint venture between the government and private enterprises from Belarus, Ukraine and Russia for the establishment of a civilian helicopter factory in Belarus. In other work, the team advised Falcon Investment on an investment contract with the Belarusian state for the development of a hotel, sports centre and other facilities.

At Borovtsov & Salei, practice head Vassili Salei acts for a number of high-profile multinational companies. He serves as adviser to McDonald’s on leasing and construction mandates for the client’s restaurants in Belarus and is assisting Franck Muller with the construction of a new production facility in Minsk. In other work, the group is assisting RRY Capital with the construction of the Palazzo Mall in downtown Minsk. Nikolay Artemyev and Illia Salei are other key team members.

Egorov Puginsky Afanasiev & Partners assists with the legal, financial and tax structuring of real estate transactions and also handles development and construction matters. The team recently advised the European Bank for Reconstruction and Development and Belarussian authorities on the upgrade of the M10 road. It also acted for Technip Benelux on the performance of a €60m hydrogen plant construction project in Belarus. Dennis Turovets heads the practice.

Sorainen is ‘skillful in real estate and construction matters’, providing valuable ‘industry knowledge and quick response times’. Practice heads Kiryl Apanasevich and Aliaksei Daryin ‘form a strong and capable team, committed to delivering tailor-made advice’. Apanasevich is experienced in real estate transactions and developments and Daryin advises on permit procedures and contract execution for construction projects. The pair act for China Telecom Global on the creation of telecoms infrastructure and a telecoms centre at the Great Stone Industrial Park.

Verkhovodko & Partners LLC fields 'a brilliant team of highly qualified professionals’ who ‘share a common goal of true care for their clients’. The team recently assisted Belagroterminal LLC with the planning, financing and implementation of a multi-functional transport, storage and logistics centre for agricultural products. Nina Knyazeva ‘has great experience in international matters’ and heads the practice alongside the ‘super professional’ Dmitry Bokhan. Attorney Ksenia Zhukovskaya is also a key member of the team.

Ekaterina Zabello leads VMP Vlasova Mikhel & Partners’ practice, which has particular expertise in construction disputes and contractual issues. She is currently acting for Royal Group Companies Management, a UAE-based conglomerate, on the proposed construction of a multi-functional complex in Minsk. The team is particularly active in the technology, FMCG and retail industries and recently advised LC Waikiki on the leasing of retail space at a prominent Belarus shopping mall.

At BusinessAdvisers Law & Tax Firm LLC, practice head Anatoly Rozhkov is 'a highly qualified expert in construction and real estate’. His team advises on investment and construction projects, and acts for a client base that includes a number of Chinese companies. In a recent highlight, Rozhkov acted for China Railway Construction Corporation No 9 on its successful bid for a public procurement contract for the construction of roads at the Great Stone China-Belarus Industrial Park.

Legaltax has a particular focus on cross-border transfers, project finance and greenfield investment projects. Eugenia Urodnich leads the practice and recently advised Lithuania-based Modus Energija on extending a deadline to complete a biogas power plant construction project, which included designing a restructuring plan.

Stepanovski, Papakul and partners is adept in a broad range of real estate and construction matters and also handles dispute resolution in both fields. Andrei Vashkevich heads the practice.

The practice at US Invest LLC is headed by Dmitry Deriugin and predominantly acts for Chinese companies and Belarusian companies backed by Chinese capital on large construction projects. Deriugin recently acted for Tianjin Electric Power Construction Company of China Energy Engineering Group on the drafting of a construction contract for a powder paints production plant.

  • Formation of the Customs Union of Russia, Belarus and Kazakhstan

    Russia, Belarus, and Kazakhstan will adopt new unified customs tariff and non-tariff regulations from January 1, 2010, and the Customs Union (the “CU”) of the three countries of the Eurasian Economic Community (the “EurAsEC”) will become a reality. The CU Customs Code (the “Customs Code”) is expected to take effect from July 1, 2010 to regulate the resulting integral customs zone.
  • Belarus Amends its Investment Legislation

    On 6 August 2009, the President of the Republic of Belarus signed Decree No. 10 On the Creation of Additional Conditions for Investing in Belarus. An investment contract is one of the ways of investing in the Republic of Belarus and enables an investor to obtain State support for an investment project and a waiver of sovereign immunity from suits, cautionary judgments, and enforcement of judgments and/or arbitration awards. Decree No. 10 introduces a new procedure for entering into investment contracts. It allows investors to be granted preferences and privileges under investment contracts, in addition to those granted under existing legislation, and also regulates the privileges to be granted to investors automatically upon execution of investment contracts.
  • Belarus Trademark Law Amended

    On July 15, 2009 Belarus passed the Law on the Introduction of Amendments to the Law of Republic of Belarus on Trademarks and Service Marks, which comes into force on January 25, 2010. The rationale behind the amendments is to bring Belarusian law in line with European countries’ laws - to facilitate eventual accession of the country to the WTO, and also to reflect new developments in case law.
