Bruchou, Fernández Madero & Lombardi’s ‘creative and solution-focused’ group consistently ranks among the best in the dispute resolution area due to its ‘extremely experienced partners, who understand court processes inside-out’. The department handles a diverse mix of contentious matters – including contractual claims, criminal cases, class actions and domestic and international arbitration – and is particularly well known for its strength in energy-related work. Among the names to note, former judge Carlos Rotman enjoys an eminent reputation in the market; he teamed up with ‘extremely sharp litigator’ Leandro Caputo and regulatory specialist Ignacio Minorini Lima to represent Pan American Energy in an ICC arbitration against Transportadora de Gas del Sur. In another headline arbitration, Rotman and Caputo acted with Enrique Bruchou to represent Papel del Tucumán in ICC arbitration proceedings against the Republic of Argentina. In a significant piece of judicial litigation, the firm successfully represented SADESA Group in a case against a majority shareholder concerning the control of one of the two electricity distributers in Argentina – Rotman, Caputo and Mariano Luchetti led that work. Martín Beretervide, who recently advised Petroken Petroquimica Ensenada in litigation arising from the termination of a contract with a service provider, and senior associate José María López Posse are also recommended.

M & M Bomchil has a prominent dispute resolution practice, which is highly sought after for its specialist expertise in economic regulation (particularly energy issues), administrative law and complex arbitration. Guido Tawil, who is widely regarded as a ‘powerhouse in contentious energy matters’, heads the arbitration department; he recently acted in conjunction with Francisco Gutiérrez, María Inés Corrá, counsel Rafael Mariano Manóvil and newly promoted partner Federico Campolieti to represent a major multinational company in arbitration proceedings (under ICC, UNCITRAL and domestic rules) brought by local subcontractors arising from a state contract terminated by the government. In another administrative law-related case, Tawil and Corrá are assisting several wheat mills with various claims against the government concerning the lack of compensation for commercialising flour in the domestic market at subsidised prices. Javier Petrantonio heads the litigation practice and spearheaded the team (which also comprised counsel Hugo Lafalce and senior associate Martín Torres Girotti) that represented Carrefour in four significant claims stemming from the acquisition of Argentine supermarket chains. The group has also recently undertaken work for Aeropuertos Argentina 2000, Peugeot Citroën and Siemens.

Ostrower recently led the group’s representation of Cargill against the Province of Chaco in a case arguing the unconstitutionality of certain provincial regulations impacting on its operations. Facundo Viel Temperley is ‘extremely effective’ and paired up with senior counsel Martín Campbell to defend Credit Suisse in a $40m class action related to the Madoff fraud. Santiago Soria is also a key contact and is acting hand-in-hand with the energy department to represent Roch in a complex dispute against Apco Austral, Apco Argentina and Apco Oil & Gas International related to the ‘right of first refusal’ provisions in a joint venture agreement for the exploitation of three hydrocarbon concessions.
